Show NOTICE TO WATER USERS The State of Utah Office of State Engineer Salt Lake City Notice is hereby given that L. R. Stubbs, Short Creek, Arizona, has made Application, in accordance accord-ance with the laws of Utah, to appropriate 9 sec. ft. of water from Short creek and Maxwell creek, in Washington county, Utah. The water will be diverted from January Jan-uary 1 to December 31 inclusive of each year, at three points described de-scribed as follows, all located from the SW Cor. Sec. 26, T. 43 S R. 10 W., SLB&M.: (1) from Short creek at a point E. 70 rds. and N. 32 rds., (2) from Maxwell creek at a point E. 48 rds. and S. 28 rds., (3) from Maxwell creek at a point E. 412 ft. and S. 16 ft. The water will ho ncorl u. ijiLcxiiiiLitrnuy to irrigate 90 acres of land located in the ENE and NEiSEH Sec. 34, and WNWH Sec. 35 T 43 S., R. 10 W., SLB&M. The water sought to be appropriated appro-priated will be diverted from Maxwell Max-well creek when it is available in said stream, but when the full flow is not available in Max-well creek, the balance necessary to make up 9 sec. ft. will be diverted from Short creek. All water diverted di-verted from Short creek, and that diverted from Maxwell creek at point iNo. z, hereinbefore described, describ-ed, will flow in a ditch by gravity to the place of use. The water diverted from Maxwell creek at point No. 3, hereinbefore described, describ-ed, will be diverted by pumping and conveyed to that part of the land to be irrigated which cannot be reached by gravity flow. Part of the water diverted by gravity will be conveyed to an equalizing reservoir, inundating one acre of land in the NE SE NE of said Sec. 34, from which it will be released, as needed, for irrigation of the lands hereinbefore described. describ-ed. As much water as is necessary will be used during the entire year for domestic use at three residences resi-dences and for incidental stock-watering stock-watering purposes. This Application is designated in the office of the State Engineer as No. 12761. All protests resisting resist-ing the granting of said Application, Applica-tion, with reasons therefor, made in affidavit form, must be filed with T. H. Humpherys, State Engineer, En-gineer, 403 State Capitol, Salt Lake City, Utah, with one extra copy and $1.00 filing fee on or before December 10, 1938. T. H. HUMPHERYS, State Engineer.
