Smith, a well-known Salt Lake attorney, won out In the race for the Third Judicial" District Attorneyship Attorney-ship yesterday afternoon when he was appointed to that position, left vacant by the death of Dennis C. Eichnor, by Oov. Wells. 1 There were a number of applicants for the place, among whom were Farley P. Christensen, Fred C. Loofbaurow, M. M. Kalghn, D. H. Wenger, W. D. Rlter and A. B. Irvine. " District Attorney Smith Is a member of the law firm of Stephens sr Smith, is prominent in social and club circles and is a Colonel on Gov. Wells' military staff. He was born at Galesburg, 111.. May 28, 1S6S, and Is a son of Judge Arthur Ar-thur A. Smith, who was Brigadier-General of Volunteers during the Civil war. He graduated at .Knox college In 1892. In the fall of the same year he was appointed ap-pointed Assistant United States Attorney Attor-ney for Utah Territory and after Utah was admitted to Statehood became As-siRant As-siRant Attorney-General. In 1838 he resigned this position and enlisted In the First troop, Utah volunteer volun-teer cavalry, under Capt. Joseph E. Calne and held the position of First Lieutenant when the troop disbanded. The appointment at such an early . date after the demise of District Attorney Attor-ney Eichnor was made imperative in order that the trial of James M.
