Show U. P. IS SUED FOR LOSS OF HORSES In a suit filed In the District court this morning by C B. Johnson, It Is charged that the Union Pacific Railroad Rail-road company allowed a carload of horses to remain In the car until they became mad with hunger, bit and tore one another, kicked and whinnied and 'In desperation tore and pulled out one another's tails and manes. The plaintiff declares that the company com-pany kept the horses aboard on three occasions, longer than the law allowed. Between Pocatello and " Green River, he declares, the horses were, without food and water" for thirty-two and one-half one-half hours, and that .from Green River to Huntsville, Ala, the destination of the car. the horses were without food and water for thirty-six hours on one occasion and at another time were In the same condition for forty-two hours. When the animals reached Huntsville, It is asserted they were depreciated in value and that one died. The plaintiff declares he is entitled to $320 damages. On the return trip. It Is asserted that the company carelessly allowed an engine en-gine to bump Into a car Injuring a blooded animal that was being brought back for the plaintiff's stock farm. The horse died later from his injuries, it is said- The plaintiff declares that he was damaged $1000 by the loss of the horse. Thomas has to leave her home on Sixth West by May L Judge Ritchie granted a motion to vacate for the plaintiff plaint-iff in the case of the Rio Grande Western railway vs. Mary Thomas yesterday. This is the first of the condemnation suits started by the Rio Grande In order to build Its spur to connect with the San Pedro tracks on South Temple.
