Kelly, 'Robert Bweden, Isaac Sorensonand James Hill, charged with murdering a man named John Djrr, near Wellsville, Cache County, in 1846, came before the First District Court at Ogden yesterday. The circumstances of the occur rence and the arrest of the offenders are well known to the public the matter having been thoroughly discussed dis-cussed by the newspapers at the time the arrests were made. Xot one of the prisoners has the expression expres-sion of a criminal. Kelly is a large, able-bodied man, strong featured, and Is apparently drawing near his fiftieth yean He possesses a well-developed held, and, although strikingly bald, tbe Iron-gray hairs that cover the sides and back of it aud the dark moustache that he supports give blm tbe appearance of a manVLher than a murdetcr. Sorerason-iis. a Scandinavian by birth, and wears' a heavy brown 1 ' beard, that jYers his entire face, and shows blm to be-an Intelligent man. Hill is a grey-haired man; he is of strong physique and has the appearance of a good-uaturtd granger. gran-ger. The testimony of some of the wit nesaca does not bear out the statement state-ment given by Kelly, and If It holds good it will undoubtedly go bard with him, William Bird testified that he and his broCier brought tbe body of Dorr found on the ptairle about two weeks after tbe affray happened. James Williamson stated that Kelly made a confession to him shortly afterwards. Kelly was drunk at the lime, but be told him that ,he had killed Dorr because be-cause William II. Maughan ordered or-dered him to, and that he shot his victim twice before ho finished hltn. The case iris adjourned. Tho following casts were al: before be-fore the court; The Feople vs. ( F. Turver-sod: Turver-sod: arraigned, pleaded not guilty, and case set for trial on the 22nd Inst. ' United States vs. Lata P. John son; nrralgned, pleaded guilty; case set forsenteuce December 13. Tno People, etc., vs. John T. Kelly etal.; postponed till Decern-bcr Decern-bcr Sat 9:30. The grand Jury came into court and presented three indictments under un-der territorial laws nnd one under United States laws. Tho People, etc., vs. Richalas Smith; arraigned and pleaded not gulltv; bail fixed at $1000; case set for trial on the loth instant. Tho People, etc, vs. Dick Rogers; arraigned and gave his name as William Uurdy; pleaded not guilty; case set for trial on the 15th instant. Tbe People, etc, vs. Tom Watts; arraigned; pleaded pot guilty; case set for trial on the 13th instant. |
