Mr. Scott was recalled and testified: testi-fied: I was appointed judge or election elec-tion by Max Beaver; he was not a Justice of the peace, but he administered adminis-tered tbe oath to me on the morning morn-ing of election before any votes bad been cast. Judge Loofborough asked permission permis-sion of tbe coart to enter a counter contest! on the ground that Illegal votes bad been cast and counted fur Dlalntlff. Mr. Rawlins' made an incisive argument against the granting of tills rt-qutat and cited the laws of California, regarding election contests, con-tests, of which tbe laws of this Territory are on that tulject an exact counterpart.
