Show SETH PiXTON SUES PAYSON BANKCASHIER American Surely Company Asked to Pav $10,000 on 15ond of J. C. Ellsworth. As nn iiftei-matU to the closing of the Ihiyson Exchange Savings bank of Payson early this year and the indictment in-dictment liy a grand jury in July of James C. Ellsworth, cashier of the defunct hank, a suit for the collection collec-tion of $10,000 has been instituted by Seth Pixton, state bank examiner, exam-iner, for the use and benefit of the creditors of the Payson Exchange Savings hank, against James C. Ellsworth and the American Surety company of New York. The complaint sets forth that the surety company by the terms of a bond entered between it and Mr. Ellsworth Ells-worth agreed to make good any loss which the Payson Exchange Savings bank may sustain, not exceeding i?10,000 by reason of any dishonesty, wrongful abstraction or wilful misapplication mis-application of any of the funds or property of Mr. Ellsworth. The complaint also alleges that while Mr. Ellsworth was employed as cashier of the bank, by reason of various acts of fraud, dishonesty, embezzlement, wrongful abstraction and wilful misapplication, appropriated appropri-ated to his use, the funds of said bank, at times and in the amounts as follows: On Sept.. 20, 1021, $138.25: Xov. 7. 1921, ,$2S7.oO ; Jnlv 17. 1919, $.'!,C4o.88: Oct.. 17, 1923. $350; Nov.. 14, 191!), $500: Jan. 17, 1920, $1,000: Nov.. 13. 1919, $400; Aug.. 27 1919, $3,585.20: May, 24, 1919. $1,000; February', 20, 1919, $7,000; iVov.. 20, 1019, $372 : Xov. 12, 1919, $1,000 ; March 5. 1919, $704: April 4, 1919, .$510: Xov. 24. 1919, $S76; March, 19, 1919, $1,740.26; Dec, 22, 1923, $150; Jan., 2. 1923, $1,000; Oct., 15, 1919; $500; Dec, 1, 1922, $500. The loss was discovered by the bank, according to the complaint, about May 13, 1924 and notice was delivered to the American Surety company of New York, within ten days afterwards. George P. Parker, of the lawfirm of Parker and Robinson, is representing repre-senting the bank examiner. |
