Show ARGYLE WINS HIGHER COURT Ben B. Argyle did- not wilfully resign the office of county surveyor survey-or of TTfnh in 1020 nnd Is entitled to his salary and expenses for that j yea r. This was the conclusion of the state supreme court Friday in nn opinion handed down reversing the j judgement of the district court of Utah county dismissing the suit brought by the former official against the auditor. Argyle had threatened to resign in 1919 if the comity commission did not make provision for appointment appoint-ment of a deputy surveyor. The county refused to appoint an assistant, but Argyle continued to serve that year. The year 1920 as marked by an extensive road construction program pro-gram leading the county board to appoint a county road engineer to make surveys of roads and directed the county auditor to refuse to make any further payments to the elected county surveyor. ! The district court held Argyle failed to maintain- an office or do any official work and in effect resigned re-signed tbe position but the supreme court reverses on practically all throe grounds.
