Show LEGAL NOTICES ORDINANCE NUMBER 78 AN ORDINANCE AMENDING NUMBER 54 RELATING TO DOGS PASSED BY THE CITY COUNCIL OF SPRINGVILLE, UTAH, ON APRIL 7, 1958, BY AMENDING THE FOLLOWING FOL-LOWING SECTIONS THEREOF: BE IT ORDAINED BY THE CITY COUNCIL COUN-CIL OF SPRINGVILLE CITY, UTAH: Section 1. Section Amended. Section 195 of Ordinance Number 54 aforesaid is amended to read as follows: Section 195. Dogs Running at Large. It shall be unlawful for the owner or keeper of any dog, whether registered or not, to permit said dog to run at large at any time within the limits of Springville City off the premises of the owner or keeper. At large shall be intended to mean off the premises of the owner or keeper, and riot under the control of the owner or keeper or a member of his immediate family either by leash, cord, chain or otherwise. It shall be the duty of all Springville City police officers to apprehend and impound any dog found running at large within the corporate limits of Springville City; and in the discharge of this duty such officers, when in pursuit of a dog found running at large, shall have the right and are hereby authorized to enter and go upon the premises of the owner or kee'per of such dog and there apprehend appre-hend the same. Section 2. Section Amended. Section 200 of Ordinance Number 54 aforesaid is amended to read as follows: Section 200. Fierce or Dangerous Dogs. It shall be unlawful for any person to harbor, keep, own or possess a rabid, fierce, dangerous, vicious or mischievous dog within the limit of Springville City, and any such dog is hereby declared to be a nuisance. nuis-ance. In the event any such dog is running at large within the limits of Springville City, any person or police officer is authorized to kill or cause to be killed such dog wherever it may be found. In addition addi-tion to any fine which may be imposed, any person convicted of harboring or keeping a rabid, fierce, dangerous, vicious or mischievous dog within the corporate limits of Springville City shall immediately immed-iately cause such dog to be removed from the city limits. In the event such dog is not immediately removed from the city limits by the owner or keeper, the Springville City Chief of Police, or such other police officer as he may authorize, shall destroy such dog. In the discharge of his duties hereunder, any such police officer shall have the right and is hereby authorized to enter., and go upon the premises ,of the owner or keeper of such dog and there apprehend appre-hend or destroy the same. Section 3. Section Amended. Section 201 of Ordinance Number 54 aforesaid is amended to read as follows: Section 201. Dog Which Disturbs the Peace. It shall be unlawful for any person to harbor, keep or own within the corporate limits of Springville Spring-ville City any dog which by barking, howling, yelping, yelp-ing, or making other loud or unusual noises disturbs the peace and quiet of any neighborhood, person or persons. In addition to any fine which may be imposed, im-posed, any person convicted of harboring or keeping any dog which disturbs the peace as aforesaid shall immediately cause such dog to be removed from the city limits. Such a dog is hereby declared to be a nuisance and in the event such dog is not immediately immed-iately removed from the city limits by the owner or keeper, the Springville City Chief of Police, or such other police officer as he may authorize, shall destroy such dog. In the discharge of his duties hereunder, any such police officer shall have the right and is hereby authorized to enter and go upon the premises of the owner or keeper of such dog and there apprehend or destroy the same. Section 4. Penalty. Any person violating any of the provisions of this ordinance shall, upon conviction con-viction thereof, be punished as provided in Section 207 of Ordinance Number 54 aforesaid. Section 5. Emergency Clause. The city council coun-cil finds and declares that it is necessary for the immediate preservation of the peace, health and safety of this city that this ordinance become effective ef-fective immediately. Section 6. Effective Date. This ordinance shall take effect upon its first publication.
