Show NOTICE OF TRUSTEES SALE whereas benjamin W driggs and olivia P daggs his wife as party of the first part executed and delivered to james H bacon trustee as party of the second part their certain deed of trust bearing date the first day of may A D 1890 to secure the payment of hundred dollars and interest thereon according to the tenor and effect of a certain principal note and interest coupons thereto attached which are more particularly described in aid deed of trust said nota being nayale pa yale on the first day ol 01 may A D 1895 which said deed of trust waa re corded in the rp corders office of utah county utah in volume ho 8 of mortgages etc at pages to inclusive of the records of eaid office and eiven upon the following described premises to wit the bouth half of lot two 2 in twenty 20 plat A pleasant grove city survey area one half and 2160 2 of an acre situate in the county ol 01 utah and territory of utah together with any and all water rights owned by said parties of the first part or either of them or belonging with or faed upon said premises or any part thereof and whereas it is provided in said deed of trust among other things that in case be made in the payment of said indebtedness or any part thereof with interest thereon as specified in eaid principal nato and the interest compone thereto attached or for non payment of taxes or neglect to gronew insurance urance ns then and in such case on the application of the legal holder of said note it shall be lawful tor said party of the second part after having advertised such sale for twenty days in a newspaper published in said county of utah to sell said premises together with all the right and equity of redemption of the said party of the first part their heirs executors administrators and assigns therein at public auction at the from door of the court houam in the eaid county ol 01 utah and whereas the eaid party of the first part and each of them have made default in the payment of the interest on said principal note due on the first days of may and nov 1893 and 1894 and whereas it is provided in said deed of trust that in case of auch default the whole of said principal sum secured by said deed of trust and the interest thereon to the time of sale shall at the option of the holder of paid indebtedness or the trustee therein named at once become immediately due and pay able and the said premises may be sold in like manner and to the same effect as said indebtedness bad fulla matured by lapse of time in said obligations mentioned and whereas the legal holder of said indebtedness debt edness baa declared the whole of said indebtedness to be now absolutely due and payable and requested sad trustee to advertise and sell said promises pursuant to the power and authority in him heated in and by said of trust now therefore public notice is hereby given that I 1 james H bacon trustee as aforesaid will DAY oi 1895 at ten a m of said day at the north front door of the county court house of fhaid utah county in provo city in said utah counte utah sell at public auction ti the biggest and best bidder for cash said premises hereinbefore described together with all the right title benefit and equity of redemption of the said benjamin W driggs and ulivia P asira executors administrators and assigns therein forever for the purpose of baying said indebted nesa and the interest thereon and the costs attorneys fees and of executing this trust and will make execute and deliver to the purchaser or purchasers at said bale good and eum chent deed or deeds of conveyance in fee for he premises cold dated this day of february A D 1895 JAMES trustee as aforesaid J W 3 ODD attorney |
