Show WILL TAKE PAVING DISPUTE TO COURT Definite Plans for Beginning Begin-ning Litigation Made at Mass Meeting. Special to The Tribune. OGDKX, Feb. 23. Definite plans for taking legal action iu the courts against the proposed paving in district Xo. 125 and also to organize a municipal vigilance vigi-lance committee to watch expenditures in the city government were put in operation op-eration tonight when a mass meeting of the paving district protestants and others oth-ers was held in the city building. It was unanimously decided to carry the paving matter to the supreme court of the state, if necessary, in order to defeat the plans of Mayor A. R. Heywood and Commissioner Commis-sioner M. L. Jones, who voted several days ago to proceed with the work. Reports were made showing that Salt Lake attorneys have said the protestants will win out it' they take their case into the courts. This opinion is based on the discovery that John M. Browning, oue of the protestants, whose 232 feet of frontage was thrown out by the engineer, en-gineer, is alleged to have signed the petition pe-tition of protest at least twenty-four hours before he transferred the "property "prop-erty to his wife and other members of the Browning family. Supreme court decisions were read as proof that the protest will stand as official, in which case the city would lose jurisdiction. Asserting that it is time to show Mayor Heywood he is living in TJtah, not Russia, Earl R. Geiger opposed and defeated the suggestion that a committee commit-tee wait upon the commissioners and give them an opportunity to rescind their action on the paving matter. "I am opposed to any such action because I do not believe the mayor deserves anv consideration or respect at all, ' 'r said Mr. Geiger. "He certainly showed us none when he sprung this Browning technicality on us at the last minute. Why should wo go to him now and tell him we are prepared to contest the matter? mat-ter? With the others here tonight I quite agree that we should see him 'in the hot place before going to him agaiu. The mayor and Commissioner Jones prostituted their high offices when thev tried to force this matter down our throats despite the overwhelming majority ma-jority opposed to it. It's time for us to show them this is Utah, not Russia " |
