Show JUDGMENTS GIVEN IN SMELTER SMOKE CASES A decree was handed down Monday by Judge John A. Marshall In the United States district court in the oaso of S. M. Whltmore and Ralph Jenkins against and the Bingham Copper & Gold Mining company. Tho caso has been pending in the court since March 10, 1004 and involves damages alleged to have been done by the two coninanles to farms owned by tho plaintiffs near Murmv. bv smelter fumes. Judge Marshall granted to Whltmore $2470.70 from the United States Smelting comnany and S1235.3S from tho Bingham company, and Jen-kens Jen-kens is granted $150S,87 from the United Slates company and 5744.13 from the Bingham company. In the written decree Judge Marshall says the indications are that Whltmore is entitled to more damages but the testimony regarding the losses was not sufficient to grant an - more than the amounts ordered. The enso of Charlotte Cassidy against the Silver King Coalition Mines company com-pany was argued and submitted to the court. |
