The state completed tho iulroduction of testimony on direct examination much sooner than expected and took tho defense slightly by surpriso when it rested Thursday without recalling important witnesses examined at the first trial. For instance. Jjena Vance, a daughter of tho prisoner and one of tho stato 's best witnesses at the original houring, wus not called, presumably for the reason that sho has made affidavit that Amanda Vanco Ward, her aunt, told her she would go to .iail if she did not testify at the first trial that Vance kicked her mother, and it is likely that the girl will bo used by the defense now to good advantage. This is tho expectation ex-pectation of tho defense, at least. When tho state announced that it . rested, A. J. Weber, chief counsel for tho defense, mado a motion that the jury bo peremptorily instructed to bring in a verdict of not guilty. This motion was denied and the dofenso then began to put. in its testimony. Mr. Weber, in support of his motion, said that tho state had not produced suflicient evidence evi-dence to show that Mrs. Vance's death was owing to blows or kicks or poisoning. poison-ing. Prosecution Closes. Tho testimony of two witnesses completed com-pleted tho state's case on direct examination ex-amination Thursday. Those witnesses wcro City Chemist Herman Harms, who mado an nnatysis of the dead woman's Btomaeh, and J. Parley White, chief deput3' sheriff, who identified the dying dy-ing woman's statement, which was made to Fhilo T. Farnsworth, then assistant I county attorney. Mr. Harms said that he had found no traces of mercurial poison in tho woman's stomach, but oxplained that the evidences of such poison would pass away within ten days. Mr. Harms 's examination of the stomach was mado almost two weeks after tho poison is al-Jegcd al-Jegcd to have been administered. Mrs. Vance's dj'ing statement charges Vance with becoming angry because Mrs. Vanco filled his cup too full of coffee and with throwing tho cup at her. Then, Mrs. Vuncc said in this statement, Vance Btruck and kicked her. The next day Mrs. Vance charged in this statement, she saw Vanco drop a tablet into a glass of water from which she drank and -became deathly sick. Statement for Defense. S. A. Maginnis made the opening statement for the defense. This statement state-ment shows that the defense will attempt at-tempt to show that there is a strong probability that Mrs. Vance's death resulted re-sulted from her own efforts to procure an abortion. Richards testified that Mrs. Ward told her after Mrs. Vance's death and Vance's arrest that "they have not got tho richt man in jail," and 'that it was Mary Vance (meaning (mean-ing Mrs. A. B. Mrs. Clara Wundcrlich said that Mrs. Cora Rchpenning was not. at the Vance home November 20. when Mrs. Vanco is alleged to have called for tho police, savimr that, her husband was killing her, and Mrs. Wundcrlich Hays that Mry. Rchpenning gained all her information as to this occurrence from others who wto there. The defense is expected tn put Luna Vance, the prisoner's daughter, on tho stand soou.
