Show COAL ENTRIES ARE DECLARED ILLEGAL Register of Land Oflice Finds That Entrymen Failed to Comply With Law. The register and receiver of the local land office have recommended that fif-' teen coal entries, comprising over two thousand acres of land In Kane county, be cancelled. This was In the caso of the United States government against Wllford W. Heaton, Francis I.. Porter. William -Av". Adair. Hans C. Sorensen, Wilson L. Hodges, Alfred R. Meoks, Howard Chamberlain, Alvln B. Reason, the heirs of Jesse M. Palmer (deceased), Henry Gardner. Thomas Chamberlain. John Li., Covington. .Edward Carroll, Jonathan Heaton and Isaiah Bowers. It was charged that these entrymen were not getting tills land for their exclusive, ex-clusive, individual use and benefit, but Intended to combine and consolidate and were thus not in good faith. The enterprise en-terprise had its inception at a meeting held in OrdcrvIIle, Kane county. Utah. August 17, 1907, when a number of citizens citi-zens met and effected an organization, of which C W. Carroll was chosen president presi-dent and Hcbcr J. Mcoks secrotary and treasurer. There was also an executive committee elected. Arrangements were made to employ two men to do the work on all of the claims and to allow anyone to enter tho organization by paying 5 within fifteen days Into the treasury- In this way there were forty-two names as subscribers subscrib-ers of the fund and members of the organization. or-ganization. Assessments were levied to the amount of $ 15 on each member, the last assessment being made April 22, 1910. The money secured in this way and an additional $600 that was borrowed on a Joint note, signed by. the members of the association, was used for surveying survey-ing and Improvements, including the building of a cabin on the property. The land office officlnls say that tho men all seem to have acted In (from their standpoint) entire good faith, with no Intentional design to violate the law or defraud the government. They placed all the evidence that they had, Including their private accounts, in the hands of the land office officials and made no attempt at-tempt to hide or misrepresent any part of their actions. The facts disclosed are similar to those In the Cunningham Alaska cases. |
