| Show LIBERAL pettifogger files a document Protest of THE commissioners RULING the reasons why onu not to be issued to officers elected in provo during mr vigil to salt anke for the purpose of hatching ap u contest case oil provos municipal n ne filed a paper tie utai as given below and succeeded gaining a most qui er ruling fron thia learned body it is strange from the fa t tunit not but one side has been heane rn iu canvass of the election has been made so nothing official is at hand from which to draw conclusions that the peoples party candidates are really elected it only adds one more evidence to a long list of the partisan actions of thesa high election dignitaries the following is the document the provo would be liberal chieftain chief liaa filed to the utah commission salt lake cilto utah the undersign eda citizen cud qualified elector of thy city of provo utah county utah territory respectfully represents that on the dav of february instant an election for officers of said city was held at the time appointed by law and that alie returns of the votes cast at said election have been made to your honorable board for canvass and for further proceedings accord he further states that provo city is known as the city of the third class as defined in the laws of said territory and tha electors of said city were by said laws authorized to choose at said election the following fol lowine of ficera viz one mayor seven councilmen and two justices of the peace besides other officers your petitioner represents that at the said election there were voted for mayor by the electris elec tois of said city one said james should be john E booth and said booth it is alleged received the highest number of votes cast and were he eligible would have been elect ed to said office but your petitioner protests that said booth is and eligible to said office or to receive said certificate of election thereto on the following grounds that said booth for a long time prior to said election and at said date was and still a is polygamist and disqualified under the laws of the united states from voting or holding any office whatever that prior to the passage of tho law of congress of march 1882 disqualifying poly as aforesaid said booth was living with in what is known as plural marriage more alian one woman as wives and continued in said relation afterwards until about 1883 that he has not been at any time pardoned or amnestied by the president of the united states though at the time of said election your petitioners petition ers do not charge that by was in the actual practice of polygamy wherefore we pray that no certificate of election be issued to baid booth and that a new election to fill aid office be ordered your petitioner further states that at paid election certain persons were voted for a 5 aldermen of said city and that alie returns of votes for said offices have I 1 been made to your board and your pe titio ners claim that said votes ft era null and void for the reason that no were to be chosen and your peti pray that said election of aldermen be declared null and void and that no camas be made of auch votes and that yon assue no certificates to the persons appearing to bo chosen your petitioner further represents that two justices of the peace for said city were voted for and elected as the law requires and that the persona who received the highest number of votes for said offices were legally elected and entitled to certificates of election and they pray that they receive from you the usual certificates to entitle them to alie same submitted chairman liberal municipal coimo t tee of provo city upon the filing of this document the commission issued alie following order in relation to the provo municipal election SALT LAKE CITY feb 15 1890 whereas liberal committee provo city has filed a petition requesting that no certificate of election be issued to jacw E booth who received a majority of the votes cast for mayor at the late municipal election held in andhor said city on the ground that bo is a polygamist under the although not charged with polygamy poly camy and also that certificates of election be withheld from two persons voted for at said election for the office of alderman and that certificates be given to I 1 certain other two persons who were voted for at said election for office of justices of the peace on the ground that said city is a city of the third class and that therefore no election for alder men could legally be held the commission after due consideration in view of the fact that both questions are of importance and are open and mooted questions which should be judicially settled advises the secretary as canvassing of aicer to withhold all such certificates of election until the parties to be affected thereby have a full opportunity to apply to alie courts for the proper order and judgment thereon G L GODFREY chairman |
