territory hall shall s nominate nd by and with the advice and consent of the legislative council appoint a fish and game colmia who shall be a resident citizen of the territory term of office shall be four years and until hia successor is appointed and qualified provided that when a vacancy occurs in the office of said the legislative council is not in acion the governor shall have power to fill buch vacancy siu 2 the paid territorial lioner shall receive in annual salary of oliree hundred and fifty dollars lie shall before t the duties of his office and give a bond in the penal tuna of five thousand dollars for the faithful of hia duties such bund shall be approved by and filed with alie secretary of alie territory fcc i tho territorial commission er shall have control and supervision of the public waters for the collection propagation pa gation culture and distribution of fish in utah territory and shall distribute all fish fish fry or coming into bis hands fairl y and equitably among the several counties or as the aard commissioner aad the county commissioners ners amny determine he shall have full control of all property of the territory obtained or held for the purpose contemplated by tins act he ahall receive all fish fish fry or that may be purchased fv this territory he mar establish hatching boxes for the preservation and hatching of splawn and in alie most economical and practical manner procure and distribute fish and fishery to the public waters of this territory he shall make detailed statement or report of hia official transactions including expenditures and the purpose for which the same were made also the number and kinds of fish distributed and the locality and names of the streams ponds or lakes where the same baye been placed and submit such 10 port to alie legislature during the first week of ais regular session sec 4 alie county court of each county of this territory shall appoint a fish and game commissioner whose term of office shall be for four years and until his successor shall be appointed and qualified said county commissioner shall before entering upon the duties of hiis office take and subscribe to an oath of office and give a bond in alie penal sum otono thousand dollaree dolla rei for the faithful performance of his duties said bond shall be approved by the pro biu judge and filed in the office of the clerk of the county court the county shall receive such compensation pensa tion as shall be determined by the county court to be paid nut ot the county treasury and shall perform his duties under the direction of alie county court it shall be the dut ct alie county commissioners to acce that the laws of this territory for alie of fish and game are feitli fully enforced and shall report his doings to alio county court bemi annually all fines and forfeitures for violations of the provisions of this act shall bei paid into the counte treasury of the county wherein the offense shall hove been committed sec 5 the eaid commissioners by authority of she territorial commissioner mastake or cause to be taken from alio public waters within their ie counties at any time or in any manner any kind offish forthe purpose of or inspection each of said county commissioners shall make a detailed report of his official doings to the territorial during alie first week of december of each year SEC G the owner or owners of any dam erected across any of the streams in this territory shall if required by said county commissioner build erect and maintain at his or their expense suitable to allow abo free and uninterrupted passage of fish up and down such streams SEC 7 it shall be unlawful for any person or persons to catch kill or take any imported fish from the public water in any county of aliis territory for the period of four years from the passage of this act unless duly by tho joint concurrence of alie territorial commissioner and the commissioner of said county SEC 8 it shall be unlawful for any person or persons to tako trout from the public waters of thia territory by any means or device whatever except by means of hook and line commonly known as angling and that only between the first day of tuly of each year ond the first day of march following SEC 9 it shall be unlawful for any person or persons to sell take catch kill destroy or have in his possession any trout less than six inches long or any trout whatever that is taken unlawfully sec 10 it shall be unlawful for any person or persons to kill or take any fish from the public waters of thia territory by the use of any poison hiis drug or by the use of giant powder quicklime or any other explosive aab stance or by the erection of any wire dam or other artificial arti fical obstruction or by the uso of any net eiene or device whatever which can or may be used for the unlawful laking of fish provided that seines not more than two hundred yards long and twelve feet wide with meshes not less than one and one half inches square for fifty yard sin the center and meshes not less than two inches square in alie wings thereof may bo used in green river at all seasons of the year and in bear and utah lakes between the first day of october of eacle year and the first day of barcli following SEC 11 it shall he unlawful for any person or between the first day of april and the first day of october of each year to wilfully take kill destroy or offer for sale an y wild geese snipe ducks aronse quail or partridge or to kill any of the above mentioned biala between one hour after sunset and one hour before sunrise or to rob the nests of or otherwise willfully disturb the above mentioned birds SEC 12 Ita liall be unlawful for any person between the first day of december of each year and alie first day of september following to tak okill or destroy any deer elk or mountain sheep or at any time to kill any of the above animals for akins and it shall be unlawful for any person or persons to export for sale or consumption either alive or dead any of the game danced in the foregoing to outside of utah territory SEC 33 A ehinea neta boata or tackle of any kind found in possession pers n who maybe found unlawfully taking fish from tho public liters of aliis territory shall be ly alie officer making and if it appears from the evidence before hc magistrate trying abo case that the seines nets boats or tackle were used or about to be or intended to ay used for tho unlawful taking of bame id hereby confiscate by alio llio order of the magistrate taken and destroyed 14 it shall be or persons to export living fish caught in any of the public waters of this territory to any point outside this territory for eith er consumption or sale SEC 15 the sum of seven hundred and tho same is hereby ap oat of any money in the ter treasury not otherwise apio printed to pay the salary of ahe said tenurial Teni rial commissioner for the vear i isaio ami 1891 the sam of five thousand dollars ur so emif li thereof as ibay in nece ssan is henby appropriated out of any in alie territorial treasury not ise appropriator to bo expended by alie territorial fish and game commissioner for the purchase of a suitable site for establishing and maintaining territorial fish hatching boxes nursery and breeding ponds and to pay tho contingent expenses of the office of the territorial fish and game commissioner for this the year 1890 and isal SEC 17 any person or persons violating any of the provisions of this act shall be guilty of a misdemeanor SEC 18 all laws in conflict with this act are hereby repealed
