Show FOR THE MINING JUDGE. The newspapers continue to discuss Senator's Kearns's proposition for a mining judge on the Supreme Court bench. We find in a correspondence a statement where the writer says: Within tb.o Ia3t eighteen months I v,as riding on r car ,to the Capitol one morning. A prominent member of tho Supreme Court stepped aboard. He met ex-Governor CharlcT Thomas of Colorado, who had tho day befoiu argued an important case before tfeo court. Tho dignified member of the Supremo Court, who i ons of the ablest nvrnben; of tho bench, find Jlkcwlro one of the frimkCL, stated to Mr. Thornnf. in my prosoncv, that it v.-ns difficult or members of the Supreme Bench, even those of long eervice on the bench, to understand the Inti lcnclcs of uilntps and land litigation. Said ho: "It (o unfortunate unfortu-nate that the Supremo Dcecb should l:e called upon to decide great question'; About v.-hlcb tho 'members lmo-,v but little. To you attorneys of tho West ihoe problems ito as familiar as your A, 25,. Cs. To us .tbuy nrc difficult to undentand." The mcmbtr of tho Supremo Court above referred to "luted the proposition accurately. Tho PnildeDt understands the s-ituailon. Therefore i i;o probability Js that tho vuetwey oslitlns v.l'l 1m lillod iy tho appointment ofi.i Western man. . It 13 not surprising surpris-ing that the members of tho Supremo Court find themselves at a disadvantage disadvan-tage iu mining cases, because at present pres-ent there is not 't member of that court who han been- especially trained in mining law. Probably Judge Mclveu-na Mclveu-na of California would como the nearest near-est to tilling the bill, but ho has never nev-er been known especially as a mining lawyer. There can be no doubt that in case tho President should see fit to mako the appointment as suggested that there is ample material to chose from in tho mining States. And it is also truo that in searching the whole lifit ; of tho bar no better suggestion could : bo made than those named by Senator j Kearus iu his public letter in The Tri-I Tri-I bune. |
