Show EXPERTS ON FISH TAILS J Caso of Shafei Bray for Selling Trout Illegally Tried Before Judge DIehl The case of the State vs Shafer Bray proprietors of the Chesapeake restaurant was called in Judge Dlohls court at the afternoon session yeSterday yester-day and much Interesting argument was heard on both sides I This case Is several months old and In the complaint com-plaint the defendants are charged with selling trout out of season Charles Perry deputy Slate game and fish warden war-den was the first witness called anl he testified that he had entered the restaurant of the accused men and ordered or-dered trout Two fish were served ho said and having eaten one he wrappel up the other and carried It away with him to be used an evidence against the defendants There was left of this fish but the tail and from this an attempt was maclu to prove that It was a black mountain trout native to Utah only This failed as It was shown that no man could distinguish between a black mountain trout of this and any other State State Fish and Game Warden Sharp his deputy Perry Horace gldrldgc and his deputy Blngley of the County Flub Commission were put upon the stand and all told practically the same story It was urged by Deputy Attorney Rlter that the defendants should bo made to show that the trout In question was cither shipped In from Idaho or some other State or that It had been taken from some lawful water of Utah Judge Armstrong who appeared for the defendants de-fendants argued that it was the State that should show the fish was not taken as described The case was taken under advisement until Monday at 10 ocloclc 0 |
