Show ENSIGN VMS GUILTY Secretary Moody Disapproves rind ings of CourtMartial in Case of Ward K Wovlman Washington Sept I Secretary Moody has disapproved the findings in the case of Ensign Ward K Worlman U S Nrnshio was tried t by court martial mar-tial and acquitted of lie t charge of culpable Inefficiency In the performance perform-ance ot duty The Secretary has read the findings and considered them Worlman on January 2nd last off San Juan was In charge of tin third jfun division on the battleship Mnssiichuacstts Including1 the two elshtinch guns in the starboard after turret when one oC them during target practice exploded InjurInG nine enlisted men all of whom afterward died diedThe court of Inquiry found Worlman guilty of poor Judgment in giving an order to open the breech of the gun for the purpose of returning to the electrical tiring while the gun was loaded and the lanyard was out and hooked to the trigger The court recommended that no further fur-ther proceedings be had in the matter mat-ter The secretary however ordered a court martial cn the basis oC the courts findings and Worlman was acquitted ac-quitted by 1 this court Secretary Moody says After a careful review of all the evidence I am of the opinion that the i nccusnd failed 10 exercise1 the care which was required of him that in giving giv-ing the order to open the breech of the gun under the circumstances which the evidence proved he was negligent that I the death of nine enlisted men resulted from his negligence find that In what he did anil failed to do In tho premises hi was guilty of culpable inefficiency in-efficiency In the performance of duty The action of the Secretary does not affect I he courts findings |
