| Show I JUDGE NOYES MUST GO President Will Dismiss tho Alaskan Jurist in Accord With Knoxs Finding i Washington Feb AttorneyGen eral Knox has delivered to the President Presi-dent his findings f In the matter of the charges filed against Arthur E Noyes Judge of the Second division of the United StatesDistrict court of Alaska The charges allege incompelency and corruption although the Attorney Genera says the charge of dishonesty was not pressed After reviewing the charge at length the AttorneyGen oral concludes his report as follows Such was the end of this Cape Nomo Alligation out of which has sprung much l complaint bitterness and public scan Jtlal After review It remains that the I actuaj consequences of these proceedings In tho Alaska District court wero to I bring that court Into disrespect and to Impair public confidence In Its wise and Impartial administration of justice In view of tho foregoing and finer tho most careful consideration I have concluded Flrat That the appointment of a receiver re-ceiver In the case referred to without notice to tho defendants and the rofusa upon hearing to discharge the receiver and the consequent dlspossesHion of the defendants of their property were not Justified under tho facts tho pleadings and tho principles of equity Second That there Is no Justification shown for the refusal by Judge Nojes to settle a bill of exceptions at tho In ulanco of the defendant and for the refusal re-fusal to allow them an appeal Third That after an appeal had been allowed by tho Circuit Court of Appeals and the writ of superscdcaa had been served upon Judge Noyeg tho plaintiffs and the receiver Judgo Noyes attitude toward the writ wan ono of hostlllly and obstruction which was totally Inponslst ont with his judicial duty towards a superior court and toward the litigants seeking through that court reversal of his judicial action Fourth That Judgo Noycs should forthwith be removed from office The President will approve of these findings and promptly dismiss Judge Noyes from office |
