Show I I SHORES DISBARMENT CASE Judge McClernan Denies Motion to Dismiss Butte Mont July 17 Judge McCIer nan today denied the motion to dismiss tho A J Shores disbarment case declaring declar-ing that enough of the conspiracy to bribe Judge Here with 250000 In tho Minnie Healy mine case had been disclosed dis-closed to warrant an explanation on tho part of the defendant The defense opened with the testimony o Lawyers John F Foibls Chief Kelly and officials of the Amalgamated Copper companys various concerns who were called to disclose alleged discrepancies In tho testimony of the principal prosecuting prosecut-ing witnesses In minor matters Arthur P Helnzc secretary of the Montana Ore Purchasing company known generally as the Helnze Interests was the most prominent witness heard His examination related exclusively to his acquaintance ac-quaintance and knowledge of Mrs A H Brackett a former friend of the Judce who accuses the Amalgamated lawyer with attempting to bribe him Mr Heinze denied acquaintance or knowledge of Mrs Brackett who Is desired as awitness In the case Attorney If L Maury of Butte testifying testify-ing for the defense testified that Attorney Attor-ney Jesse B Roote had told him positively posi-tively that Judge Harney had been bribed In the Minnie Healy decision that State Senator J iI Kennedy had paid him the money and that the money had been paid In the offices of a Butte semiweekly paper Maury testified positively repenting repent-ing his conversation with Roote who he said came to him during the famous Rochester suit and said that Judge Har fey > was In trouble and that he Roote wanted him Mnury to co to Rochester and get him to keep his mouth shut Maury was attorney for Rochester |
