Show CONWAY G VES RAH Secures His Appearance to Answer Forgery Charge BOND WAS FIXED AT 2000 I His Sureties Were Frank Knox and Stephen Hays Tho Suspicions of Rov Sir Wake Were Aroused by Alleged Changes in tho Abstract of Title Which Disappeared and Afterward Turned Up Mutilated Having it is Said Been Run Ovel by a Street Car I J Porter J Conway the stockbroker j I I I who was arrested at an early hour on Sunday morning on a charge of forgery I I forg-ery and uttering a forged instrument sworn to by h Rev Richard Wake alleging > leging that Conway forged the names oC John Bacr and wife to a mortgage for 2000 and the name of Charles R I I Simpson as notary public and attestor I to the signatures of the Baers went before Justice AtcMostcr about noon yesterday and gave bond In the sumo j sum-o 2000 for hla appearance His sureties sure-ties were Frank Knox and Stephen I Hays The warrant for Conwaya arrest ar-rest was issued about G oclock on Saturday Sat-urday evening and Sheriff Howells I and Deputies Harries Montgomery and McDuff scoured the city for hours In I search of him He was finally located I at Murray and arrested by Deputy Sheriff Harries about 2 oclock In the morning It was thought that Conway Intended to get away and the Sheriff notified Gand Junction and other points south as well as Ogdcn to lookout j look-out for him Conway however said i to the officer that he only went to Murray to avoid the Inconvenience of arrest at night and being obliged to remain In jail until he could obtain bondsmen In the morning or probably have to wait till Monday R L Col burn went with Harries to Murray and counselled Conway not to make I any attempt to escape and after that I he made no effort to elude the officers I He was not put In jail but was kept f = at hiD room In charge of Deputy Harries Har-ries until he furnished tho bond EAER IN GERMANY I Baer the owner oC the property and the man whose name Conwa Is charged with forging is at present In Germany Simpson the purported notary no-tary viis some years ago a clerIc In Conways office and at that time was a notary public but it Is said he has not been here for some years and his name docs not appear on the list of notaries for Utah at the present time I The complaining witnesss story of I the transaction as told to the County Attorney is that he received 2000 from his brother Thomas Wake of Ne biaska to Invest lie consulted Mr I Conway who told him he could place 1 tho loan for him on a piece of property prop-erty on Eighth East street Wake examined ex-amined the pioperty and was satisfied to lend WOO on It provided the title was good Stephen Moyle the abstractor ab-stractor madn an abstract of the title which Wake handed to his attorney George F Goodwin to pass upon Its validity Goodwin approved it and it was handed back to Conway to draw j up the note and mortgage RECORDED THE MORTGAGE Conway said it was all right and j that he would send the mortgage lo Lo recorded He did so and It was duly recorded on Friday Conway met Wake and ijhc latter was prepared to handover hand-over the money but didnt have his check book with him and In the meantime I mean-time ho took another look at the abstract ab-stract of title and it struck him that sone changes had been made on It after It came from the hands of Moyle Wake said these changes appeared to him to be l In regard to clauses showing that there were two other mortgages on the property prop-erty prior to the mortgage which he was about to accept as security for the 2000 After thinking It over he I says he asked Conway again for the abstract but Conway said his boy had lost It jfiatcr In the day he brought it to Wake in a mutilated and dirty condition saying that It had been dropped in the street and the wheels of a street car had passed over It cutting cut-ting portions out of IL Stephen Moyle > L 1 u lilt al LIUILUl YU LUHl u J UU UL the suposed changes to the abstract I and Wake and Moyle then consulted the County Attorney The mortgage In favor of Wake which had been filed was then examined by the County Attorney At-torney and by Wake and Moyle with the result that they concluded after r I comparison with the signatures of the I parties known to be genuine that the signatures on the mortgage to Wake were forgeries and the complaint against Conway was made As stated Wake had not paid over the money but he says he was fully prepared to do so when his suspicions that all was not right were aroused Mr Conway was reluctant yesterday to discuss the case against him He said that he had a good > defense to tho charge and that he had not committed any offense |
