Show IDAHO SHEEP CASES LR ROGER DISCUSSES THE RECENT TRIALS AT MALAD Says Cry Is Home Range for Home Sheep and Health of Animals Docs Not Count unt Lindsay R Rogers attorney for the Utah WoolGrowers association returned re-turned yesterday from Malad Ida l where he had been since December 9th defending the members of the association sociation on trial there for the violation viola-tion of the proclamation of the Governor of Idaho relating to the taking of sheep from Utah into th tStat Mr Rogers made some statements that will be of deep Interest inter-est to the aheepmen of the State These prosecutions were Instituted he aRid not to keep out Utah sheep Infected with scab but to keep out sheep of any kind The cry up there Is the home range for home sheep and the question as to whether the sheep are clean or unclean has very little to do with tIle matter This idea Is set forth In the Democratic platform plat-form adopted in Malad last year The plank on this subject reads Realizing Realiz-ing that the free use of the public ranges of Idaho is necessary to the up building of the State and to tho best welfare of its farmers stock and sheepmen we reaffirm our steadfast opposition to any policy that will preVent pre-Vent such free use and pledge our candidates to the Legislature if ele ted t-ed to use all lawful means to reserve the benefits of said ranges to our home people I This platform said Mr Rogers is backed up by the addresses sent out by the party leaders during the campaign They call upon all sheep men to vote the Democratic Legislative Legisla-tive ticket on the ground that the Democratic candidates ratcclndldatc being sheep men themselves would be able to do more than their opponents In securing legislation in favor of the sheepmen the State and in favor of shutting out sheep from the outside These ad dresses were signed by W H Thomas D W Jones andJ H Dredge a committee com-mittee of sheepowners of Malad valley val-ley These facts are given to show State the sentiment that prevails in that Take the case of Charles R Reed Of Ogden said Mr Rogers warming to his subject he had in his possession posses-sion a certificate from T G Lowe the State Sheep Inspector of Idaho by D H Anderson deputy for Oneida and Cassia counties It states that his sheep were inspected In Pocatello af ter crossing over from Box Elder county Utah and found to be free from scab or any other disease In the face of this Mr Reed was arrested I on the charge of violating the proclamation procla-mation of the Governor of Idaho and was one of those trIed whUe I was there He was found guilty and sentenced I sen-tenced to pay a fine of 200 He appealed ap-pealed his case to the Supreme court court 1 I I Is clear from this that the offense was not In taking unclean sheep Into the State of Idaho but in taking sheep of any kind Into the State His sheep were certified to be clean by the proper prop-er officials of the State The other cases tried at this time tme Mr Rogers continued were those of Louis Sampson of the firm of Sampson Samp-son Brothers of Salt Lake who was convicted and fined 500 and appealed to the Supreme court Sam Gillette of the firm of Gillette Brothers wool growers of Tooele City Tooele county who was acquitted Ed H Hill foreman fore-man of A R C Smith the wellknown shqepman of Ogden who was convicted convict-ed and fined 500 aIm who appealed to the Supreme court Jeremiah T Kel lar of American Fork who was convicted con-victed and fined SSOO and who appealed to the Supreme court and Jeremiah Stocking of Salt Lake who was acquitted ac-quitted The prosecutions were backed by David L Evans a prominent promi-nent and wealthy merchant and sheep man of Malad and his brother Alonzo and the prosecutions were to prevent the grazing of Utah sheep on the pub lie domain of the State of Idaho Jesse M Smith of the Utah Wool Growers association was with Mr Rogers during the time of the trial and returned to this city with him yesterday I is the opinion of both gentlemen that the cases will be fought through to the end and that the Supreme Su-preme court will take a different view of the matter from that held by the local courts of Idaho |
