Show HALVOR HOPE IS HELD MUST STAND TRIAL IN THE DIS TPICT COURT Hope is Oharged With Murderous Assault As-sault on W E Ncibusch Bonds Fixed at S3000 lialvor Hope was held to answer to the District court by Judge Tlmmony yesterday in bonds oC300 on the charge of having aspaullcd with intent to kill W E Ncibusch The trouble grew out of the fact that Hopes cow had chdwed up a shirtwaist and a skirt belonging to Nelbuschs wife and had also trespassed upon a lucerne patch Ncibusch demanded damages and Hope refused to pay anything So one day after some time had paused Nulbusch saw the meekeyed bovine grazing along the streets Ho annexed her and when Hope came and demanded de-manded the lacteal fluid producer In order hat the children might have bread and milk for supper Nelbusch paid he could have her when the dam age she had done had been settled for Hope said something about damages be hanged or words to that effect and proceeded to replevin the animal In the good oldfashioned way by force J Tie even took down a portion of Iho fence Then It was that the two men mixed And right here Is where the testimony adduced Is also a trllle mixed Hope did not deny that he had shot his pistol but says lhat It was not until after he had been dinned by Nclbuech with a big piece of board i I When Nelbusch made a swipe nt him wiln the board he says he alruck him 011 the head wllh the pistol and when I Nolbuech Insisted upon following him up ho fired the plslol In the air Just to 1rlKlUcn him Nelbusch however and several other witnesses contradicted this they I say I Ins that Hope laid deliberately aimed at Nelbusch and that It was not until after the shot had been fired that Nclbupch grabbed a board and had made after the defendant They were I all certain that the wound on the side 01 the head had been made by l the bullet bul-let from the 32callbar pistol which was in the hands of flop In summing up the case Judge Tlm mony said there was but one tiling for him sitting as a committing magistrate magis-trate to do and that was to hold rhe defendant to the District court While there was conlllct of testimony there wa reasonable cause lo believe hint Hope had shot Nelbusch as claimed by the latter and his bonds would be Hxod at 300 |
