Show SALISBURY WINS CASE Not Responsible for Transaction of J T Gilmer Two opinions were handed down by the Supreme court yesterday one an affirmation and the other a reversal In the case of Kate Gutheil adminis tratrix of the estate of Moroni R Williams deceased appellant vs J T Gilmer O J Salisbury Monroe Salisbury Salis-bury and the firm of Gilmer Salisbury Co the trial court was affirmed in an opinion written by Chief Justice Barlch and concurred in by Justices Miner and Baskin ThP action was to recover from O J Salisbury who was the only defendant upon whom service of summons was made 5500 on an agreement entered Into by J T Gilmer a partner in the firm of Gilmer Salisbury Co with Williams whereby Williams was to receive re-ceive that sum on the sale of the Peabody mining claim The trial court nonsuited the plaintiff plain-tiff on the ground that neither O J Salisbury nor the firm of Gilmer Salisbury Salis-bury 5 Co were parties to the transaction trans-action which ruling the Supreme court sustained |
