Show Trustee's Sale. W'HEREAS, LEONARD S. OECOOD AND Ruma L. Osgood his wife, on the first day of December, 1881, made, executed and d.-livered to Eu.il J. ftaddatz their certain promissory note for the principal sum of three thousand three hundred and sixteen 30-100 dollars, payable to the order of the said Emil J. Kad iatz, ninety days after date thereof, with inteie.-t thereon at the tats of one (1) per cent per month until paid. Hnd Whereas, to secure the payment of said note the j said Leoi ardS. Osgood and Buma L. Osgood on ! said day made, executed and delivered to S. Mc-i Mc-i Ilowall as trustee for the said Emil J. Baddatz ' their certain trust deed in writing of that date, j which said trust deed was duly certified, acknowl-! acknowl-! edged and recorded in Use office of the County Recorder Re-corder of Tooele Couu.v, Utah Territory, on the I third day of December, 1881, aid thereby conveyed i to said McDowall the following mining pioperty. to wit. : An undivided three-fourths (;) interest of, in and to the "No-U-l)on't" Lode, mining ! claim, situate in the Rush Valley Mining District in the said County of Tooele, designated as U. S. Survey, lot No. 88, and more particularly do-scribed do-scribed in and by said truat deed. Also an undivided undi-vided three fourths (5) interest of, in and to the Laura Lode, miniitg claim, situate in the said Rash Valley Mining District, County of Tooele, Utah, more particularly described in and by the location certificate thereof recorded in Book F, at pug 12 of the records in the office of the District Dis-trict li cordarof said Rush Vain Mining His trict and in and by said trust deed. Also oneO(ll upright boiler, engine and blower now upon said 'No-T Don't" mining claim, and Whereas, it is provided, m said trust deed that m case default be made ill the payment of said promissory note, that the said trustee might pro ceed to sell, and sell and dispose ol said premises or any part thereof, and all right, title, benefit and equity of redemption of the said Leonards. Osgood and lluuia L. Osjrood, th. ir lc-irs and assigns therein either in mass, or separate parcels par-cels at public auct.on on said premises or any pait thereof, for the highest and beet price the same will bring in cash, twenty days previous notice of such sale having lieen given by publication pub-lication in any newspaper at that time rublished in the county of Salt -Lake, itah Territory, and out of the proceeds of such sale, first to pay the cost of advertising, selling and conveying suiii preniies. including a reasonable commission, to tho trustee for his services and a reasonable attorney 8 fee and all other expensee of this trust. secondly, to pay to the holder of said promissory promis-sory note" such sums as he may have paid lor taxes or assessment on said premises, or to extinguish ex-tinguish any outstanding title or li. ns thereon. Osgood have not paid said promissory note, nor any part thereof, and the same is past doe and payable. Now, therefore, in consideration uf the premises, and of the power vested in mo by said Trust Deed and by request of tl.e legal h r of said promissory note.
