Show THE TOWNSITE CASE. It Is Still Holding tho Fort at the Land Office. Mr. Patterson was again put on the stand on re-direct examination in the Eureka town-site town-site case this morning. His testimony was about the same as has already been published in The Tim M. Judge Sutherland then offered in evidence the Held notes on tile connected with application appli-cation for patent in the Wolfe Tone lode; the date of the official survey for patent is .January 19, ls'.H, and also the Held notes of the official survey for patent, of the Home Stake lode, which is filed in this office, the date of the survey being November 14, 18110. Mr. Bird "We object to that as being wholly incompetent, irrelevant and Immaterial Imma-terial to this issue." Judge, Sutherland then offered in evidence the official field notes of the survey for patent of the Home Rule lode, on tile in this office, date of survey December '-!'!, 1S90. Joseuh Stonebraker was the next witness called for towusitc claimants. After a few important questions he was asked: "How long have you lived in Knreka?" "1 have lived in Eureka the principal portion por-tion of the time since the spring of 1ST0." ''What has been your business there." "Mostly mining." "Do you know the boundaries of the townsitc, as they have applied to make the entry in the land office i" "I do not." "Do you know where the compactly built part of Eureka is?" "Yes, sir." "Do you know where the Wolfe Tone mining claim is f" "I saw the ground that was pointed out to me where the claim was ou the 10th, of month." "By whom?" "By Mr. Patterson and Mr. Watts Judge Watts, some, call him." "Don't you know Mr. T. D. Sullivan?" "Yes sir." "Didn't you know the Wolfe Tone claim, owned by him, before it was pointed out to you?" "No sir." "At the time it was pointed out to you, on the 10th of February, did you examine the dump at tha shaft ?" "No, sir, I did not." "Have you ever examined that dump?" "I have been over that ground a number of times." "But you have not examined the dump?" "Yes, I have examined it at different times." "What indications of ore did you see on the surface of that claim or on the dump?" Mr. Bird objected. "I have never seen any ores; that is, what I would call ore." "At what time did you make your last examination ex-amination with reference to ore or mineral on the claim ?" "Alone, in I he fore nnrt of Die winter." "Alone, in the fore part of the winter." "What mineral indications did you discover?'' dis-cover?'' "Nothing moro than some iron stained granite or uorphyry, something of that kind ; 1 wouldn't call it mineral." "Arc you familiar with the surface of the paying mining claims in the vicinity of Eureka?" Eu-reka?" "Yes, sir, 1 am." "Does the bedrock appear on the surface upon them ?" "At tho most of the principal mines tho rock is permanent at the surface." Then the, witness goes on and says that the surface roi k on the Wolfe Tone is not as permanent as it is on the paying mines, etc. The witness was still on the stand when we went to press. |
