Show THE BURNS MURDER TRIAL Slow Progress Is Being Made by the State Testimony of but Four Pour Witnesses Taken Manti Mant Oct 7 Monday afternoon at 2 the trial of or Archibald A Burns charged with the murder m of or James Fisk Jensen at lit Mt Pleasant during the month of or March llarch last was continued The court courtroom courtroom courtroom room was crowded with spectators who were evidently anxious to hear the testimony testimony mony mon of the witnesses that may be called and each day so tar far f r has been about the same as to numbers In attendance The witness called by the state was ex Sheriff H P Jensen formerly sheriff of this county who enjoyed an excellent reputation among the people during his terms of or office Mr Jensen was an eye eJe eyewitness eyewitness witness to the murder which occurred in the saloon formerly owned by the de deceased deceased deceased ceased generally known as the Jim Fisk saloon After the opening statement to the jury by b County Attorney Lewis Lar Larsen Larsen LarSen sen sen Mr Jensen Jens n was called to the stand and examined and by b the attorneys representing both sides Ides of the case His testimony was to the effect that the deceased Francis Jensen a of or deceased and Peter Sorensen were standing In the front part 01 OL o the saloon by the cigar case having a quiet conversation during which time young oung Burns passed them two or three times passing in and out of the saloon The last time Burns I entered the saloon the witness testified that the defendant after passing passin them turned turnell his head toward the three and ant made a distortion of the face expressing disgust dis or contempt for de deceased deceased deceased ceased and continued his way wa into the barroom and from there Into the pool poolroom poolroom poolroom room In this part of or the building there were two partitions one between the cigar stand and the bar and one between the bar and poolroom After Burns dis disappeared disappeared disappeared appeared from the front part of the sa loon deceased made a remark to the th ef that he would not stand for an insult of oC that kind and Immediately after fol lowed Burns Burn entering the parti tion Lion leading to the poolroom where Burns was at the time deceased placed his two hands uplifted on the swinging doors lead Ing to the poolroom opening them sufficiently to see ee the defendant and while he was stilt still holding to the doors his feet and body hod being mostly In the barroom de deceased deceased deceased ceased ripped out several oaths addressed to the defendant calling him vile names and ami asking him why he was hounding him Only Onh a very ery short time passed until Burns was facing his opponent and he Immediately grasped deceased by the wrist with his left hand and It H was as at this time that two shots are arc said to have been fired Ired Into the body of the deceased which felled him to the floor loor Burns then entered the barroom and the witness tes titled that two more shots were fired Ired Into the body bod of Jensen after which Burns started toward the front entrance during which time deceased raised sufficiently from his back onto his right side and anti bringing brin ln his hand to his back presumably to his hip pocket produced a revolver which he fired ired over oer his right shoulder in the direction of or Burns Burn while In that tion having his head toward the ceiling his feet being in an opposite direction to Burns the bullet striking a few feet be he beyond beyond yond ond his head The Tho testimony further showed that Burns turned immediately toward Jensen and fired a fifth shot at the deceased Francis Jensen another eyewitness also testified substantially to the same as the first witness but admitted during his testimony that Burns while deceased was abusing him asked deceased several times to let him alone Ho also stated that while Burns Bum was making grimaces at de deceased deceased deceased ceased he made the remark Take a good look at me roe governor He H also alo tes that he ha had seen the gun In the hands of Burns which fired the first two shots which the first witness could not testify to as he could not see that part of the proceeding from his position in the saloon One of the points the defense seem de desirous desirous desirous sirous of bringing out Is to prove proe that the deceased was holding a gun In his hand while holding open the swinging swin doors during the use of the abusive language to Burns but so 50 far no admissions have been made to that effect erret but quite ford bly to the contrary It Is expected that the defense will vill have witnesses who can testify that the deceased decEa d held a weapon in his hand at that time which let the de tte to make his sudden defense The day da of oC the tragedy was cool and blus bIns and the defendant is said to have his overcoat keeping his right hand in his overcoat pocket most of the time whether taking a drink or otherwise which was also brought out from some som of ot I the witnesses Peter Sorensen another witness who was in the barroom at the time of the shooting was on the stand yesterday and part of ot this morning mornin but his testimony upon direct examination was rather badly had punctured upon redirect examination of the defense Sam Hansen manager of the saloon where the deed occurred was the next witness called He lie was in the poolroom when the murder was committed and was asked among other things the positions in the room the defendant occupied He testified in part the things formerly ex expressed expressed expressed pressed by b other witnesses He states that the visits Of Burns to the Fisk saloon were more general when deceased hap happened happened happened to be there than otherwise The attorneys for the defendant read to quite an extent from the testimony given at the preliminary hearing which was at times in contradiction to the testimony of ot toned by the witnesses so far hard and no doubt some points of or importance were gained as to the truthfulness of the wit witnesses witnesses witnesses nesses for the state The case is progressing rather slowly as only four of ot the most important wit witnesses witnesses nesses for the state have so far testified |
