Show DECIDES AGAINST DURAND Judge Armstrong Denies Motion Notion to Quash One of Countless Writs Involving Justice Court Judge Armstrong of ot the district court yesterday again rebuked the conduct cond cf of the notorious kangaroo court at nt Murray presided over by Charles s F Durand by denying the motion of the justice to quash one of the almost countless writs of certiorarI which have vo been recently recent applied for against him and his associate Francis G Luke The case was that of at Washington Jenkins of Ogden Mr Ir Jenkins was sued Oct 26 1906 by Mrs H C Smith for an alleged debt of ot 59 and the summons was issued out of or the Murray court and served on him in Ogden Im Immediately ImmedIately Immediately mediately thereafter Nov No 5 1906 Jenkins filed an affidavit with the court setting up that he was Avas not with within in Its jurisdiction which is apparent from reading the statutes and asked that the tIe case be dismissed No date for hearing was as set and Jenkins knew nothing of the tho case until Jan 2 1907 when ho he was informed that a judgment for had been entered against him by default Angered at such out outrageous outrageous outrageous procedure he applied for the writ to prevent collection on the Judg Judgment judgment ment meat until the matter could be heard in the district court In his petition he says sas that Luke was at the bottom of the deal and that he bargained with Mrs Smith to collect the alleged debt provided she would pay him of the proceeds The motion to quash was based on the ground that the petition did not state sufficient facts to warrant the is issuance issuance issuance of the writ but Judge Arm Armstrong Armstrong Armstrong strong took a different opinion of ot the matter 11 |
