Alexander Burt, sworn for defendants de-fendants : Was one ot tho policemen who went with Hampton and assisted to demolish plaintiffs property. He repeated the Btory of the breaking sworn to by Alex, Burt and Hampton. Hamp-ton. Capt. Burt was not at plaintiffs house while the destruction of proper-was proper-was going on. Andrew Smith, policeman, sworn for defendants : During the smash-up smash-up witness guarded the front door of plaintiffs house. He saw nothing of the destruction of property. W. G. Phillips, policeman, sworn ! for tne defendants : Was not present at the lime of the destruction of plaintiffs properly. Had previously been through the house, and had noticed no-ticed the furniture, eomo of which was new and some waa secondhand. second-hand. Charles Kingwood , pol iceman , sworn for defendants: Was one of the defendants in the suit, but was not present at tho destruction of the property, nor had he any hing to do with the same. Was on the outside of the building all the time, but knew not who did tho breaking. John Nicholson, sworn for the defendants: de-fendants: Waa present, as a newspaper news-paper reporter, at the destruction of plaintiff's property; witness gave an account of the aBair. Testimony for the defense closed. Kate Flint, plaintiff, was called in rebuttal of some of defendants' testimony. Thcs. W. Jennings, merchant, was called by plaititiu to testify to the value of laces. Henry Emory, for plaintifl testified tes-tified to having delivered some carpets car-pets to Kate Flint early in 1S72. Testimony closed, and court took a recess till 1.30 p. in. At 1 30 p.m. the arguments of counsel were commenced, McBride opening for plaintiff, Sutherland & Bates following for defendants, and Kober'sou closing the case. At the request of several jurors who represented that they were sick and unable to sit and consider the case, the jury was excused till Monday morning at 10 o'clock, when it will be charged by the court. Court adjourned till Monday morning morn-ing at 10 o'clock. |
