He said he had endeavored to lay before the jury the situation of the parlies as set forth in their character and relatione, which would enable the jury to jude of their movements. He would call attention at-tention to the fact that in December, 1870, Beecher referred Bowen to hU (Beecher's) wife. There was an aspect as-pect attempted to be introduced into this case that there was an attempt on the part of Beecher to preclude all knowledge ol his relation with xMis. Tillon from his wile, but the parties on the other side never brought any papers in proof of this accusation, but when Bowen was re-lerred re-lerred to Airs. Beecher he was told that Mrs. Beecher had letters that her hush&Lid received from Mrs. Til-ton Til-ton while his wife was in Marietta. The jury could have no doubt but that all Beecher's correspondence was in the hands of his wife. Til ton, in tho direct-examination, denied that there was any separation or incompatibility incom-patibility of views between him and nis wife until the final abandoning ot her borne by Mrs. Tilton. In the light of the evidence, what became of this view of the plaintiff and of the faith of the jury m the foundation of the cause thus laid in falsehood. The evidence was very plain as given by Beecher, supported by Bessie Turaer and Bowen and Bell. According Accord-ing to Beecher there came like a thunderbolt upon him a revelation of cruelty on the part of the wife and of infidelity on the part of the husband. This revelation came from Bessie Turner, and when he was Bpoken to on the subject he referred them to his wife, and there was a conclusion in which Deacon Bell took a part, and then came the Blip from Beecher to his wife when he was busy and could not attend to the matter. In the conversation between be-tween Bowen and Beecher there was disclosed the whole transaction, and he was referred to Mrs. Beecher as having the largest knowledge bearing on the subject. Beecher then took counsel with Bell, one of his parish-oners, parish-oners, about the matter, and followed Mb advise. Beecher stated to him that Mrs. Tillon had left her husband's hus-band's house and gone to her mother's; that Tilton's licentiousness had been very low, and his conduct : to Mrs. Tilton had been marked with great cruelty; that Mrs. Tilton had sent to consult him, and Mrs. Beecher Beech-er had been brought into the conference. con-ference. The jury had proof of Til-ton's Til-ton's cruelty and profligacy, and that his wife needed protection. Beecher's note to his wife read that he was inclined in-clined to think Mrs. Beecher right, and that a separation was best. She never received any of his confidence. She was never deceived by any disresem-blance disresem-blance between his face and heart. Storrs was a witness who was a friend ot Tiiton and the latter said it he had happened to meet him he should have made him his confidant instead of Mbulton. Were this bo what a pity he failed to find a friend who possessed the intelligence and integrity integ-rity of Storrs. Now tho latter testified testi-fied that on the 2d of January, 1871, Tiiton tolu him that hisof ground complaint com-plaint against Btecher was that he, and Mrs. B. aud Mtb. Morse had been telling stories against him to Bowen and influenced his wife agaiiiBt him. The testimony proved these were the causes of Tilton's 'itrcd towards to-wards Beecher. When Tiiton was recalled he did not utter a word of denial of this entirely new matter introduced in-troduced by Siorrs. The theory ol the plaiuti'tl was that it was rot until the lofty crown had been taken away until the shrine and sceptre bad been packed away that stories against Tiiton poured in upon Buwen. The truth of these stories he did not propose to discus?, but Tiltouset up tho theory that until his removal they had not been reported to Bowen, and Beecher had no instrumentality instru-mentality in his removal by Bowen. It was ptetended by plaintill that he was a wealthy and prosperous man until the act ot Bowen in discharging him; he pretended that it was not until the cuimes of St. Ann's were ringing in the year 1S71. that he was first aware that any moth had corrupted corrup-ted the garment of his pride. It was when he found bis attempt to intimidate intimi-date Beecher had only completed his ruin that Tiiton determined to resist Beecher by getting around that great, generous heart which Tiiton testified made Beecher great. The report was so was fresh as to cause a letter to bo written Tiiton about it, and to induce him to write a letter in reply. He said the woman in question was merely a little girl and treated the matter lightly, as a scandal gonving out of scarcely nothing. It was not desirable by Tiiton and Moui-ton Moui-ton that they be represented repre-sented as blackmailers, and in compelling Bowen to pay money, which he did not legally owe by publishing pub-lishing a document which would involve in-volve him iu the scandal, the reason it was necessary that they represent that the Winsted matter and similar stories were wholly without foundation. founda-tion. The testimony showed that this alleged school girl was a matured young lady, and that the circum stances of the atfairs as narrated by diinteresti d witnesses wero such as to justify the report of Tilton's conduct, con-duct, and to justify, Bowcn's action. In the interview between Tiiton aud Bowen, in which the latter described the horrible scheme aud system of profligacy practiced by Beecher from his residence in Indianapolis down, the suggestion was made by Tiiton that Beecher made improper prouo-sals prouo-sals to his wife entirely eclipsed all the rest in Bowcn's mind. Buwen had been dealing for years in cloudy calumny, but here was something tangible, something recent, something some-thing that people woulu believe. Ho urged Tiiton nut lo let 'his rest, but check this career of profligacy n'once, i'ilton asked why Bowen did not use the terrible facts in his possession, pos-session, and Bowen said trial his honor forbade him because of the setllemi nt of th difficulties between him and Beecher. Why did not Bowen think ot this before he told Tiiton all these stories. The letter to Beecher was then prepared, containing contain-ing a demand for lieecher's retirement retire-ment lrom Brooklyn for reasons known to himself. That bold blackmailing black-mailing letter put Tiiton in his power, Beecher received the letter, read it, and did not fall down dead, Beecher asked Bowen if ho came there as a friend. According to the hitter's testimony, and Bowen answered an-swered that he was not hostile to him. If Beecher had been present at the interview before tins between Tiiton and Bowen, what would ho have thought of Bowcn's conduct. These conspirators, Bowen and Til-ton Til-ton and Moulion, when th' y were together, though no eye saw or no ear heard their machinations.
