Show COURT PROCEEDINGS. Third District Court McKean, C. J. Presiding. deckmher term fortieth day. Tuesday, Feb. 23d, 1875. Court convened at 10 o'clock a. m. Samuel L. Clemens vs. John T. I Cain, et al. on motion of plaintiff's counsel a decree was granted against tbo rlpfnrlar,t. O. F. Strickland 03. Flagstaff S. M. Co.; by stipulation of counsel defendant's defend-ant's attorneys were given ten days additional time in which to file their answer. The people, etc., vs. TbomaB E. ' Ricks, indicted for murder; "District 1 Attorney Carey for the prosecution, Sutherland & Bates lor the delonse. Tlie cause having been set down for trial to-day, it was called up, when the people's attorney moved tor a continuance con-tinuance on tho ground that the chief- witneu Inr . , r,1JQ,., , 1 t within the jurisdiction of the court; also that the said witness was sick and unable to attend, but had promised to do so after his recovery. Defendant's counsel opposed the motion, stating that a definite time had been fixed for the trial, the witnesses who had been , subpoenaed from distant places, were all in attendance, and it would occasion occas-ion great inconvenience and expense to postpone the caso. The court sustained sus-tained tho motion for a continuance, and the trial was indefinitely postponed. post-poned. Defendant's counsel then asked that their client be admitted to bail, which was den'ed. The pecple, etc., vs. E. X. Field, indicted Jor larceny; Tilford fc Hagaa, defendant's attorneys, filed a motion to quash the indictment. Court adjourned till Wednesday morning at 10 o'clock. |
