Cum-CummiDga; Cum-CummiDga; the motion for a new trial having been considered by the court, it is therefore ordered that a new trial be granted and a new trial ordered; plaintiff excepted. Ihe U. S. vs. Wm. T. Fields, charged with secreting and embezzling embez-zling a letter; on aikdaviu filed by the defendant, in each of the four cases against him, of the absence of material witnesses, the court ordered a continuance for the term, and that the four indictments bo consolidated into one. The U. S. t?. William Smith, or cutting open a mail bag; the defendant defend-ant being in open court, in his own proper person, waa arraigned and entered a plea of not guilty. The following were empauuelled and sworn a jury to try the case: I Benjamin F. Cummings, S. J. Lees. Wm. A. Bills, Warren F. Reynolds Henry Simons, Francis Armstrong, Edward L. Butterfield, John Reading-, Nathan J. Lang, Geo. F. Prescott, I james MCiiume, jonn w.sneii. The following witnesses testified on behalf of the United States: Ji. T. Parlin, R. E. Thompson, Vado Masby, C. A, Huntington, W. P. Bennett and Thomas H. Sears. The court instructed the jury that the evidence of the United States witnesses would not authorize them to find a verdict of guilty, and in consequence thereof, the jury returned the lullowing verdict : We the jury find the defendant in tho abovo case not guilty. S. J. Lees, Foreman. The defendant wa3 accordingly discharged. dis-charged. Nathan J. Lang, a juror, hereto-fore hereto-fore fined $o0 for being absent when called, upon showing cause the court remitted tho fine and discharged the1 rule. Court adjourned till Tuesday at 10 o'clock, a. m. |
