Show Important Decision. Wo understand Associate Justice Emerson has filed his decision in the oontested land ease of J. M. Cain cl al., vs. Brigham Young et al., involving in-volving the right of ownership of tho land on which stands the Emporiu m building, the Cooperative drug store and others on that lot. When the towusite was en'.ered by the mavor a number of parties filed claims on that land, and among them the heirs of the estate of Joseph Cain. The Trobate Judge, in his decision, apportioned the property to the several occupants. An appeal was taken to tho Third District Court, and the case was submitted sub-mitted to Judge Emerson, who was then sitting in this district. The ruling which has just been filed confirms con-firms that of the Probate Judge, following fol-lowing tho decision of the Territorial Supreme Court in Mary G. Uuesey i-crsus Job Smith. |
