The adjourned term of the Supreme Court of the Territory met at the Ci'y Hall yesterday morning, at 10 o'clock, Chief Justice McKcau and Associate Justices Emerson and Borenmu 011 the bench. The bar was well represented, repre-sented, the court room being lull of j attorneys from this and the other districts. Chief Justice MeKean stated tin t this was an adjourned session of 11 0 October term of the Supreme Court of the Territory; at the commencement of the term last October the Court had designated two gentlomeii to act r.s bailiffs J. Tyson, on the part oftbe United States and It. W. McAllister On the part of the Territory. There were now no cttses before the court in which the United States wus a party, and thoreforo there was no occasion for that bratuh of the court being opened. The bench would continue the practice adopted utthe lastdtssion ot the term, and have Mr. MeAUi.-tor act as court baihfl for the Territorial branch of the court. Thereupon R. W. McAllister opened the court. Judge J. C. Homiugrny, 9f the committee to present the resolutions of respect to the memory of the lato James M. Carter, adopted at a bar meeting last Winter, aroso, and in an eloquent, and pathetic tone, delivered the following; SPEECH. J 1.) it jilease your Huntn: .The melancholy distinction bos lii.en upon me to announce to tins court the death of a distinguished member o f its bar. The resolutions which I hold in my hand commemorate commem-orate the virtues and abilities of James Maurice Carter, and in the name and on behalf of hia brothers in tho profession, who have affectionately affection-ately inscribed their sentiments therein, I am charged with the pleasing pleas-ing and sorrowful duty to beg that your honors may order the monument their hearts have budded up, may be preserved among tho sacred archives of this court. These arc the resolutions: resolu-tions: (Mr. Hemiuray then read the resolutions adopted at a bar meeting in this city shortly alter the death of Mr. Carter, last December.) His death oceuied t midnight Decembfr the 9th, 1873, hi Uiis city; and so sudden, so unheralded was his demise that Ids inrmediato friends were "terror-stricken and prostrated with grief, while the whole community commu-nity stood dumb with awe! The lips of etrong men grow pale as they bowed to the fiat of an inscrutable Providence. The summony was so startling that we have scarce recovered recov-ered from the horrid sound; Bom in the city of New York, reared in the State of Maryland, in the vigor of his early youth be emigrated emi-grated to California. There, siule handed, combatting with the rude Fortune of the times he wrung from her smiles that few bavo won. While pursuing the daily avocations of a tutor, f.udjtheu clerk of Napa County, by his untiring application and industry indus-try he successfully acomplished his profession and soon rose to eminence and distinction at the bar. His residence resi-dence in this Territory datui from March, 1SUG. During that residence, as these resolutions testily, he was au ornament to the profession and au honor to his friends. But wc do not look to his profe-s-. ional career, brilliant as it was, lor j words of admiration the highest we can bestow, or the warmest, most heartfelt eulogy we can make. His private life w.is marked by those graces ol person aud qualities of bend and heart, which endeared him to his family and friends. But a few days remain and we shall join him beyond the dark and shadowy river. He is but ciir advance guard into the cold, gloomy and cavernous descout. But thirty-live years of age be gave promise of a long lifo of usefulness, aud of comfort and happiness to his friends and relations- However much we may deplore his loss, wc can never know the woes of that grief-smitten wife, that aged mother, or the sorrows of those broihors and sisters he has left to mourn his loss.
