Show THE BEALL-DUMCAN "KI3-AP-PR0PRIAH0N." A few weeks ago it was freely charged against Captain R. T. Be&ll I'ost trader at Fort Cameron, and Mr. B. L. Duncan, deputy U. S. mar-s:ial, mar-s:ial, that they had appropriated to their own ue money which Marshal Maxwell had entrusted to them to Py the expenses of the Second District Dis-trict court. The Tribune in this city publishec: some letters from Beaver on the subject.from their regular cor-1 cor-1 respondent, which severely censured the parties above. Mr. JameH.Brown, Uu attorney of Beaver, sent a communication com-munication to the Tribune, making a statement concerning the alleged mis-appropriation of funds, and calling call-ing the attention of the editor ot that paper to the irresponsibility of its correspondent. The lribune editor declined to publish Mr. Brown's communication, and in a letter to that gentleman said "It would be in ex- treiuely bad taste to hold him ("Boy-d") ("Boy-d") up to the public gaze in the light ' you (Mr. Brown) represent him. It seems too much like fouling vourowu ne.-; ." iJr. Brown's communication to the ZVfWjhas reached us with a request for its publication. It wiil be found below. be-low. This is not the Heuald's fight nor is this journal interested in it except ex-cept to see justice done. We have stood aloof in the matter, hoping and believing Messrs. Bead and Duncan would establish their innocence; and now that we have the word of a respectable re-spectable member of the bar that they are guiltless, we cheerfully give it to the public, which the T, ibune should have done, and perhaps wjuld, had it not been for "fouling its own nest." Here is -ME. BROWS 's stateliest: Foi:t Camerox, U. T., Aovember 6th, 1S74. Editors Tribune, Salt Lake City: In your issue of November 3d, J find a correspondence from Beaver city, over trie aigiianne of Henj. A. -pear, headed "A Fraud Exposed-Government Exposed-Government Funds Misappropriated General Maxwrtl Fails Among Thieves," n flectinir severely on Deputy Dep-uty United States Marshal B. L. Duncan, Dun-can, and R. T. Beall, post trader at Fort Cameron. Personally knowing the tacts and circumstances, as the friend of the parties assailed, I desire that your readers should know the facts and status and character of your correspondent, Benj. A. Spear, (alias "lloyal"' ) self constituted leader of the liberal party in southern Utah, and general protector of the government govern-ment of the United States, (army and navy included). The lacts are that no such amount of money as represented in the article referred to was sent to R. T. Beall for defraying the expenses of the court. Tnis fact I know from having examined exam-ined all the correspondence between the Fir.-t Xat cual Bank of Sa t Lako City and R. T. Beall. I find from a final statement of the bank dated October 19. 1S74, a brge balance duo R. T. Beall; that upon a recent visit of General Maxwell to this place everything was satisfactorily explained, explain-ed, and R. T, Beall, in open court, before 1 is honor Judge Boreman, made an explanation fuily accounting for the funds received by him to the sanitation of the court and audience, shal Duncan fiom tho charges preferred pre-ferred in the articleabove-meutioned, and extended an invitation to any interested party to examine his books and correspondence. Now, as to the character of Benj. A Sfiear, your correspondent, I have only this to say; and the same will ba j-aid by almo.it every good citizen of Beayer: He is a recently discharged cook of R. T. Beall, post trader at Fort Caimron, upon whose bounty he has lived for the lust two years, too lazy to work and may bj too cowardly to steal, yet ha- eked out a miserable existence. To find the status of your correspondent you have only to enquire en-quire ot any rcpectable citizen of Beaver, be be "Mormon" or ''Geu tile," and especially his widowed I uidlady, to whom he owes his board for more t iau one year. The friend of tho Tnbuit- were surprised that you would receive and publish correspondence corre-spondence refl 'Cting upon officers of tlio court and responsible business men of the country from such irresponsible irre-sponsible sources. In fine your correspondent cor-respondent is regarded in Beaver as a bummer. Respectfully, James n. Brown. |
