Show The Kitchen Case. At two o'clock. yesterday afternoon, the case of 0. W. Kitchen, for striking strik-ing John Ferrol, ono of his waiter boys, on the day previous, cam up for trial in the Police Court. Witnesses Wit-nesses were exsmined on both sides, and from the evidence given the case was as follows: On Thursday morning, morn-ing, Ferrol and Wilkins,both waiters, were discharged from the Walker House. The young men understood they had been discharged, because they were accused of putting cayenne pepper on the ball room floor, at Iiusscy's Hall, Wednesday night. After receiving their wages from the clerk of the hotel, Ferrol, who was under the influence of liquor, atked Kitchen for an explanation, when the latter pieked up a chair and said he "would give him an explanation," and at the same time commenced striking at Ferrol, mUsing him once or twice, but finally hitting him twice over the head with the chair, and as j the young man was leaving the office . striking him on the back. Ferrol fell! at the door of the hotel, and was taken by his friends to the White House, whero he remained for some time in a delirious Btate. i Dr. Thompson testified for the defense, de-fense, that he was called to visit the young man between nine and ten o'clock on ThursJay evening, and found him at the Salt Lake House, and in a raving state, but thought probably it was caused by whiskey. Another witness, who hud been with Ferro1 all day, with the exception excep-tion of about fifteen minutes, said the latter had drunk no whiskey since before he as discharged in the morn, ing, and that he was delirious all day; while Ferrol himself did not remember remem-ber being at the Salt Lake House at all, We havo been thus particular in publishing the full particulars of the case, as given in the evidence, because be-cause there were some unprofessional intimations made by the counsel for. the defendant in Court, yesterday, that the Herald in noticing the arrest ar-rest of Mr. Kitchen, had overdrawn the facts relative to the injury. The judge, in summing up the case severely reprimanded Mr. Kitchen, and fined him S50. The counsel gave notice that he would take an appeal. |
