Show HAVE WE A CITY AUTHORITY ! This is the question involved in the abatement of the liquor establishment on Saturday. The proprietor of that establishment set the municipal authority au-thority at defiance. The proper city authority issued the warrant to abate his establishment, and the proper city officers executed it. Yesterday Alderman Alder-man Clinton, who issued the warrant, Marshal McAllister, Chief of Police Burt, and the regular and special offi- ' cers engaged in the matter, were arrested ar-rested on a charge of riot, we believe, and taken before Judge Strickland, ' when they acknowledged the issue and execution of the warrant, and were bound over, the Alderman, Marshal, Chief of Folice and officer W. Hyde in bonds of $10,000 each; while the others were held in the moderate sum i of $2,000 each. The preferring a charge of riot against individuals instead in-stead of directly suing the city for j damages, is a trick so transparent that a child could see through it, and looks like the last, dying kick -of those engaged. en-gaged. The excessive bail demanded some folks would call a gross outrage; we will say i: is merely an exhibition of what would be done if it could. We have labored, under the belief that there was a charter organizing this municipality and empowering its officers within certain bounds; Congress Con-gress believed so too, and sanctioned that charter; but various and sundry lawyers and judges have found out that it is worth no more than the paper it is printed on. Heaven help the poor souls ! They have worked themselves into a sad state ! And they are so determined that misrule shall rule, that they care not who they ruin. The Herald will defend the rights of all, and when it sees the rights of the people, or any portion of them, invaded, in-vaded, it will speak in plain terms, and will continue to denounce these repeated attempts to ignore every Territorial authority, until nil the courts in the Territory are honored and respected, and not merely those where District Judges preside. |
