Show FOR TEN THOUSAND Trial of a Damage Case Against the Western Provo Jan 5A 10000 damage case against the Rio Grande Western Rail way company instituted by W B Slick was begun today before Judge Dusenberry This suit was brought to recover the amount mentioned for personal per-sonal damages which are alleged to have been sustained because of a bad beating and bruising received at the hands of a conductor and brakeman in the service of the defendant company The trouble occurred last Thanksgiving day at which time Mr Slick started for Salt Lake City to visit his wife His testimony was substantially a related in The Herald at the time He claims he was laid up for two weeks suffering from bruises about the head and ribs and also from a severe kick in the mouth which cut his lip and knocked out a tooth In the cross examination Judge Howit attempted to draw from the witness own testi mony that he owed a considerable amount of money to saloons livery stables etc and that he would not pay his accounts when able to do so TRUST DEED DECISION A decision was rendered by Judge Dusenberry in the case of George D Tonneyclift vs George T Peay wherein where-in the defendant puts in a crosscom plaint charging plaintiff with tampering tamper-ing with a certain trust deed making it read so as to cover more land and give title to more water than was intended in-tended to be conveyed The judge decided de-cided for the plaintiff it appearing that the defendant had not objected to the sale when he was present at the time it took place I was asked in this crosscomplaint that the sale beset be-set aside and the deed be declared null and void I was to this prayer that the judge gave an adverse decision I |
