Show PROVO PARAGRAPHS I WILL OF THE LATE PRESIDENT snOOT V Grand Jury Crowds in n Lot of Business Several Indictments Fop Keeping Gambling Uonacs Court and NOTTS Ifotes r Provo March l3The will of the late President A O Smoot was filed for probate yesterday Reed Smoot A O Smooth jr and James W Bean are named as executors The will provides pro-vides that 1 just debts and liabilities liabili-ties be paid including funeral expenses ex-penses and for the purchase of a monument not to exceed 2000 in price and distribute the residue among the several heirs The executors are given power to dispose oC property for the payment of debts or to reinvest V The will is explicit and not lengthy I GRAND JURY REPORT The grand jury reported that there was no more business to be considered and were ready to make their final report I re-port The court permitted them to report i re-port and excused them until April 6 I at which time they will report to consider con-sider some important case recently brought to the attention of the court The court thanked the grand jury for j the great care taken in bringing in i dictments All cases reported on to 1 date have been exceptionally good cases for the people and the United States The report is as follows The grand Jury of the February term present the following report Our labors commenced on the 18th day of February 1895 and have continued con-tinued till the present time with the exception of Sundays and legal holidays labor days making twenty days of actual laborThirty United States cases have been investigated twentysix indictments indict-ments found under the said laws three cases ignored and one referred to the next grand jury Ye examined twentysix cases under the laws of Utah territory twentytwo indictments indict-ments were returned and four case caeea Ignored We have also examined six cases where parties came before U3 with their grievances and found no cause for action i We visited the Utah county jai and V made a thorough inspection and found it in good condition and consider it well suited for its purpose V TVe also visited the territorial insane asylum and through the courtesy of Dr Pike in showing us through the several departments de-partments we found it in good condition condi-tion and consider that great credit is due the superintendent and directors of said Institution for the cleanliness and order that appears throughout the premises We have examined all the witnesses which we were able to obtain in regard re-gard to gambling in Provo city and have found some indictments in that class of cases in our opinion where it is possible to surpress the evil complained com-plained of cases over which a justice of the peace has Jurisdiction should be disposed of in those courts and thereby save expense to the territory Were a proper course pursued by the city officers in the cases we believe satisfactory results could be obtained Where person are arrested under the city ordinances and inadequate bail is fixed and upon the forfeiture thereof no further steps are taken in the case we think such a method virtually amounts to a license of this class of offenses COURT KOTES The grand jury reported having found seven indictments under the laws of the territory and ignored the case of obtaining money under false pretenses against Hatch Halliday and Caldwell the men who were charged with salting the Dead Man mine An order was made exonerating their bondsmen The bondsmen of Carlos Young whose case was dismissed last term were exonerated He was accused of larceny and there was not evidence to convict The case of The People vs Herman Burmester embezzlement was taken up and tried Burmester is accused of cashing a check and using the money for his own use In progress The case of the United States vs Rachel Davis was taken up Mrs Davis was accused of adultery committed com-mitted at Payson with Charles N Pat ten in October 1893 The jury found the defendant not guilty Mrs C D Hancock was granted a decree of divorce from her husband Solomon Hancock together with 25 per month alimony and 50 attorneys fees The decree was granted on th e grounds of desertion and failure to provide The defendant did not appear ap-pear James Griffith pleaded not guilty to an indictment charging him with burglary burg-lary In breaking Into the Denver and Rio Grande railway depot at Eureka on February 19 1895 D D Houtz and Robert Anderson were by request of the defendant appointed to defend him Trial set for March 21 The People vs Thomas Irvine assault as-sault with intent to do great bodily harm guilty The court sentenced Irvine Ir-vine to seven months in the peniten tiarP S M Duggin William Marsh William Wil-liam Wilson and Nate Neibour were arraigned on Indictments charging them with allowing gaming in their places of business Reading of the indictments in-dictments was waived and defendants given till Friday morning nest to plead |
