Show KNOCKED OUT AGAIJT IcArtliiirForTeit GranJelor Process Oroinn Patents Void I Again has the McArthurForrest gold extraction process received a black eye through an adverse decision by the supreme court of Germany before which suit was commenced for cancellation can-cellation of the patents This places both the English and German supreme courts on record against the patents and there can b little doubt but that the South African decisions will be on the same line These decisions have great interest here in Utah and throughout en ire west in fact by reason of the recent commencement of the suit against the Mercur Gold Mining and Milling company limited for the purpose pur-pose of testing the patents of the cyanide cya-nide process generally in use the right to use which in the United States waa purchased by the plaintiffs from the McArthurForrest people The Mercur I company demurred to the allegations of the complaint and the matter was to have been argued on Tuesday but I Instead a continuance was taken without with-out day and it 1 is not known when the I hearing will be had There is no I doubts in the minds of the STercur I people and the many other American users ofthe patent a to the final outcome out-come of the suit for they are certain I that the decision of the Utah courts 1 and also those of the Supreme Court t of the United States will be in their favor and against the alleged owners I of the patent rights As a matter of fact the suit is looked upon as a blackmailing black-mailing scheme but the defendants will never submit to such work and the other cyanide users have rushed to their rescue The expenses of the suit will be borne pro rat I The news of the decision just rendered I ren-dered by the German courts is given by the Engineering and Mining Journal Jour-nal in its last issue the statement being be-ing as follows By the decision of the 2nd at February Feb-ruary 1895 on motion of the German Gold and Silver Parting Works the supreme court of Germany has cancelled can-celled the German patent No 47258 of 1 the 21st a December 1887 granted to the Cased Gold Extracting company limited of Glasgow This patent protected pro-tected the socalled MacArthurFor rest process for the extraction of gold ores which consisted In treating the pulverized ore with a solution of potassium potas-sium cyanide whereby the gold and silver is dissolved The mea are then precipitated by means of zinc or In any other suitable way The chief cause for the cancellation was the publication of prior American patents covering the principal feature of the above process The same patent has also been recently cancelled in England Eng-land The case is of no special importance im-portance to Germany and England as but little gold ore is treated there I is probable however that the decision of the German and English judges will bearing the decision have an important bearn on decision de-cision of the court in Pretoria before which a petition has likewise been brought for the cancellation of the aiacArthurForrest patent |
