attorneys for T J EverilJ aru1 other policemen who were unlawfully unlaw-fully removed by Chie Pratt and subsequently sub-sequently reinstated by decxee of the suprC1Tlc court The plaintiff in the case of T J Everll1 ys George Swam citt audItor of Salt Lake City through the undersigned signed his attorneys is willing 10 com promire the said action before an appeal ap-peal is taken to the supreme court upon the immediate pament by the city of the stun of 2530 which repre S cents the amount of salary due to the I said plaintiff a1id his severai aS5dgnors under the salary ordinance and which is the amount for which the suit was brought iee intest and costs By aecepting this offer for compro mfse the city will save 14446 interest and costs estimated at 8245 making a total saving of irrigation deptrtment for cleaning clean-ing canals and ditches and preparing for the spring floodS Almost immediately imme-diately after this action was taken Councilman Robertson offered a resolutIon reso-lutIon directing the watermaster to report re-port the amount of money expended in I preparing for high water how the same has been expended an estimate of the cost of carrying out the WORKED Thecity attorney submitted the following fol-lowing Answering your resolution of thq 22nd inst requesting my opinion definIng defin-Ing the state law which prohibits the I proper authorities from making the I city prIsoners doing some manual labor 1 together with such suggestions by which this council may be enabled to I make prisoners earn at least three meals a day I have to say that under paragraph 52 of chapter 1 of the re I yised statutes the council has power by ordinance to provIde for tile arrest fine or setting to work on the streets or elsewhere of all vagrants mendicants I mendi-cants and prIsoners found in the city without vIsible means of support or some legitimate business Apd also by section 211 of the revised statutes the city councIl has power to provide by ordInance that every person committed for violation of the ordinances ordi-nances may be compelled to do such public work on the streets or elsewhere as may be desirable The matter was referred to the commIttee com-mIttee on municipal laws with directions direc-tions to draft the desired ordinance Relative to the petition of David F Walker to be allowed to construct a sidewalk on temporary grade in front of 28 to 82 Vest Second South street the committee on streets recommended granting the request until such time as the connecting walks are rebuilt to established es-tablished grade By a vote of 7 to 7 a motion to recommit the report was lost and by the same vote the committees commit-tees report failed of adoption On motion mo-tion of Councilman Allen the board of I public works was then instructed to consider the propriety of having all WantS on that block brought to permanent perma-nent grade Robert L McCall and other property owners on South Temple street rayed that the council enforce without delay its order of March S requiring the Oregon Ore-gon Short Line Railroad company to lower its tracks to the established street grade from Fourth Vest street to the Jordan river On the other hand C J Oberg and other propertyowners on South Temple street protested against the lowering of the tracks Both petition peti-tIon and protest were referred to the street committee with directions to I report within a week Chairman James Sharp of the board or regents of the University of Utah submitted a communication stating it to be the sentiment of the regents that the state board of land commissioners In dealing with the old university site should have in mind that the property should he retained for educational or I some other desirable public purpose I City Engineer Kelsey
