joint assembly when it appointed thIs committee com-mittee selected it to sit as a court of Inquiry to hay its findings before tho jonlt assembly for the purpose as I understand un-derstand it of guiding them in their action ac-tion In selecting a United States senator sena-tor The joInt assembly has no right to exercise a judicial function but its duties are purely of a ministerial character char-acter I i think it would be an improper course to adopt either of the reports i If it is wise that some person be vindicated vindI-cated let an indictment 00 prepared I am seareoly prepared to say that Mr McCune has been guilt of brIbery because be-cause that is thc matter to be settled by the judge and jury Nor am r prepared pre-pared to say that Mr Law isguilty of solicIting n bribe for oC the amendment He said I am heartily In favor of the amendment I thInk both reports should be placed upon the same level It is not a unanImous unan-Imous report from the entire committee This CHARACTER ASSASSINS I Senator Smoot followed stronglY Urging that the amendment be defeated i defeat-ed and one report adopted The proposition sir not to consider and act upon these reports is a very strange proceeding to me he said I admit that I am too dUll to comprehend any high motive that any member can have In suggesting that these reports be permitted to pass by unconsidered and una ted upon To fail do so sir puts this bOdy of ladles ana gentlemen in the position of having enacted the most gigantic farce in the history of the state Accepting the proposition of the gentleman from Salt Lake why instead in-stead of supporting the proposition to support the report of the committee did he submIt di1 amendment creating committee here to see that the charges were submitted to a grand jury He comes in at this late date after conferring judIcial powers on this committee and submits now the proposition propo-sition that it should have been otherwise other-wise If there is anything to be done j let them go before a grand jury That sir can yet be done But we appoInted that committee We gave them instructions we conferred con-ferred upon them powers they have performed their duty and submitted their report and I say sir that there is 110 citizen that has a rIght at this time at this hour to bob up here and object to definite positive action being talten on those reports It is simple I justice that some expression should be made Jt is justice to the man who was accused upon the floor of this house h h L L u v IlL JJVUY VL CVll1l1l1lUlIg a hIgh crIme The committee who were appoInted to investigate that have made theIr report and It Is our most solemn duty sir as members of this assembly and as American citizens to act upon this report and do it manfully man-fully and in no way attempt to dodge the issue Every man on this floor who is supporting a certain candidate who was accused of a high crime Is Implicated Impli-cated as being a party to that crime I sir not only in my behalf but in behalf of the grand constituency that I have the honor here to represent demand de-mand vindication On the floor of this houseby innuendo and almost by direct dI-rect charge every man supporting A W McCune has been accused ot being corrupted And now the very men who were so glib in castIng those innuendoes Innuen-does and coming so Glose to direct charges are the men today that stand upon this floor and object to definite action being taken upon the report of the committee that has performed its duties as we directed It to do r ear sir that It Is unmanly and cowardly I and I demand justice for myself and I the man I have supported I Representative Bennion favored non consideratIon He said I think I rather favor the motion of Representative Represen-tative Richards and In dOing gO 1 believe I be-lIeve I do not cast any reproach on the members of the committee The whol thing all the subfect matter is before thIs legislature and one member is abOut as prepared and other I feel to hold an these men In due regard and to give due weIght to all their deliberations delib-erations And therefore I am not In favor of discussing hIs matter any further I think we should let them be filed and then let them go Representative Johnson fo1lowed In favor of flUng the reports lry jUdgment is he said that there is no use iii taldng unless something some-thing Is going to be
