Show I DUSENBERRY RESIGNS I Fourth District Judge Will Quit On May e t SUCCESSOR IN DOUBT 1 + WILL BE MANY OANDIDATES I FOB TEE ACANOY + Bar Committee Received Judge Du senberrys Resignation and Last Evening It Was Placed In the Hands of Governor Wells Who Accepted It Promptly t Judge Warren N Dusenberry last evening tendered the governor his resIgn res-Ign tlon as judge of the Fourth judicial district through the agency of a committee com-mittee consisting of S R Thurman D D Houtz and T W N Whllecot I ton of Provo These gentlemen were last Saturday appointed by the Bar association to walt upon the judge and demand of him his resignation which hey did with the result above noted The missive Is a plain brief statement state-ment and assigns no reasons merely stating that the resignation wlll take effect on the 8th of May next By that time Judge Dusenbem will have attended at-tended to all unfinished business and will leave the dockets clear for his successor The resignation was prompt Iy accepted by Governor Wells whose i duty it wlll be to appoint a judicial officer for the remainder of the term or until Jan 1 1901 Candidates for tile appointment are plentiful and the next few days may determine to whom It wlll fall though Governor Wells was In no position to state anything definite last evening It is not unlikely that a Democrat wlll be chosen the fact considered that the Fourth district comprising Utah Uin tah and Wasatch counties Is and has always been overwhelmingly Democratic Demo-cratic In both general md local elections elec-tions The demand upon Judge Dusenberry Is the outgrowth of his fondness for Intoxicants or the more direct outcome out-come of his recent conduct at Vernal which has already gained some pub licity through the daily press The members of the bar once before took upon themselves the question of the jUdges fitness to sit upon the bench and decided against him though that decision amounted to naught The jUdge refused to resign Now however how-ever he fully realizes his position and at the conclusion of the meeting of the Bar association Saturday when he learned of the disposition of those associated asso-ciated with him he voluntarily acceded ac-ceded to their wishes and true to his agreement has formally resigned the office The attorneys are not actuated by any desire to do Judge Dusenberry any injury Far from It His warmest personal friends are among those who prevailed upon him to resign His prompt acceptance of their terms was greatly appreciated and but adds to se the feeling of sympathy they express towards him Judge Dusenberry was elected In November 1896 to succeed Judge Hatch who filled by appointment the I unexpired term of Judge E A Wilson the latter having resigned on account of tailing health JUdge Dusenbem entered oqIc Jan 1 1897 He Is well up In his work and leaves a clear and unobstructed fieldED field-ED OFF COMMITTEE Lawyers Not Given a Chance to Tell of Bars Action Special Correspondence Provo April IJudge Dusenbem has resigned Today he handed his written resignation to the committee I that had the matter In charge and at a meeting of the Bar association this afternoon af-ternoon the committee reported this result and the report was accepted The committee consisting of S R Thurman D D Houtz and J W N WWtecotton left for Salt Lake on this afternoons train to place the paper bearing the judges resignation In the hands of the governor When the committee waited upon his honor yesterday the judge stated that he had been notified previously of the aetlon of the bar and that he would inform them without necessitating necessi-tating an official service on their part of the request ot the bar upon him that he Intended to resign that It was not his wIsh to oppose them and that he would no longer stand in the way of their wishes in the matter of his resignatIon Judge Dusenberrys resignation will take effect on the 8th of May Until then court wlll go on as usual Judge Dusenberry straightening up some matters he has had charge of and Judge rcCarty of the Sixth district attending to cases In which he has been disqualified ICI I |
