Show Enabling Act for Utah THE HERALD has a copy of the bill introduced in-troduced in the Houseof Representatives at Washington by Delegate CAINE to enable en-able the people of Utan to form a constitution consti-tution and state government It provides that all persons now qualified to vote for members of the legislature may vote for delegates to the number of 107 to forma form-a convention at an election ordered by the governor thirty days beforehand to be held on the 5th day of August The Utah commission is required to make anew a-new registration of voters under the United States and territorial laws The convention is to meet on the 27th of August Aug-ust The constitution shall be republican republi-can in form and provide by irrevocable ordinances first for perfect religious tolerations second a disclainor of title to the unappropriated lands and a pledge to levy no texan covernment lands third the debts and liabilities of the territory terri-tory to be assumed by the state fourth provision for a system of nonsectarian public schools The constitution con-stitution when made is to be submitted sub-mitted to the people for ratification or rejection re-jection at an election held at a time fixed by ordinance The returns after being canvassed by the governor and secretary of the territory are to be certified to the president who will issue his proclamation proclama-tion etc Section 5 of the bill provides that a representative rep-resentative in congress governor and other state officers may be elected on the same day of the election for the adoption of the constitution Section 6 declares that upon admission sections 21632 and 36 in every township and where such sections have been disposed dis-posed of equivalent lands shall be granted to the state for the support of common schools provided such sections are not embraced in permanent national reservations reserva-tions Section 7 One hundred sections of un appropriated lands are granted for public buildings at the permanent capital l Section 8 One hundred thousand acres are granted for an agricultural college Section 9 Ten per cent of the proceeds of the sales of public lands in the statesold by the United States after the admission after deducting expenses is to be paid to the state as a permanent school fund only the interest on which shall be used Section 10 The educational lands granted shall be disposed of only at public pub-lic sale for not less than 55 per acre the interest only to be used in the support of schools Section 11 transfers the lands granted in 1855 for a university in Utah to the state none to be sold for less than ijo per acre the income to be used for university purposes only It providesalso that none of the proceeds shall be used to support any sectarian school college or university univer-sity Section 12 exempts all mineral lands from the grants in the act but the state may select other lands in lieu of the same Section 13 In lieu of swamp overflow and saline land grants to new states the following appropriations are made amounting to more than 1150000 acres of land For1 the establishment of permanent I reservoirs for irrigating purposes 500OCO acres for an insane asylum 100000 acres a school of mines 100000 acres for a deaf and dumb asylum 100000 a reform school 100003 for state normal school 100000 acres for an institution for the blind 100000 acres for a miners hospital hos-pital for disabled miners 50000 acres The United States penitentiary near Salt Lake City and all lands and appurtenances appurten-ances connected therewith and set apart and reserved therefore are hereby granted to the state of Utah The above appropriations are subject however to deduction of the lands hereto ore donated to the territory for similar purposes The state may lease any of the lands for periods not more than five years Several sections of the bill relate to the judicial system looking to appointment of a district judge district attorney and marshal clerks etc with powers duties and compensation the same as allowed bylaw by-law to similar offices They provide also for the transfer by the convention of cases appeals etc that may be pending in the territorial to the state courts Section 19 appropriates 530000 to defray the expenses of the convention Section 20 provides for the election of state officers Representatives in the 53rd Congress and United States Senators It is known to THE HERALDS readers that separate enabling acts are not favored by the Republican majority in the Senate and caucuses of that party have been wrestling with tko question of an omnibus omni-bus bill to include New Mexico Utah Arizona and Oklahoma |
