Treasurer County ClcrU and Poor House Su perlntciiclent Kartells CouIt Also Meets and Adjourns In the territorial supreme court yesterday yester-day Attorneys Brown and Henderson submitted sub-mitted a petition for a writ of mandate in the case of George W Bartch Harvy Hardy and John Butter together with J P Cahoon constituting the county court of Salt Lake county vs H V Meloy The petition sets out that George W Butch is the duly qualified judge of the probate court of the county that Harvy Hardy and John Butter were elected se Jectmen in August 1S91 for a term of two years etc That said Meloy was elected county clerk and exofficio clerk of the said court at the November election and that the said Meloy is now the acting clerk of said county and court that after his election qualifying and introduction into said office he refused to and i still refuses to recognize the plaintiffs I when so organized sitting and acting as the county court and that he refused on Jan 3 to attend the said court and upon the same day refused to read the minutes of said court and declined to produce for their use the records of said court and that he refused and still refuses to recognize recog-nize the orders of said court within its jurisdiction and to obey the same as he is bound and required to do that the said Meloy pretends and assigns as a reason for his refusal to perform his duties as clerk that the said Harvy and Butter are not legal members of the court aforesaid and that although duly elected in August Au-gust 1891 for two years they have been legislated out of office by virtue of an act of the legislature whereas the saidHarvy and Butter are still in truth and in fact acting members of said court no proceedings proceed-ings Having been taken to determine their rights to the office but that they are now in possession of said office and performing the functions thereof that the said Cahoon has declined to join in the application for the writ prayed and hence is not a party thereto Wherefore plaintiffs demanded for themselves and the county that their writ of mandamus directed to sfjd Meloy be granted commanding anC frecting him to perform MB duties as couuty clerk and exofficio clerk of said county court in obedience to the commands of the said county court when in session composed of the said plaintiffs and the said Cahoon or of the majority of them and to recognize recog-nize the said Hardy and Butter as members mem-bers of said court and to command the said Meloy to attend the meetings of said courtand produce the minutes and records of the same and to obey the commands of the said court with the jurisdiction thereof there-of and for further relief The writ was issued as prayed and was made returnable Friday morning at 10 oclock I PROCEEDINGS OF THE COURT ii i i Reports of Several County Officials Sent to the Now Court The new selectmen met yesterday morning morn-ing at 10 oclock in the probate courtroom court-room and in doing so they anticipated the old board which had arranged to meet at the same hour Selectmen Cahoon Bamberger and Morris were present and after they had taken their seats a resolution was passed in which Clerk Meloy was instructed to notify Judge Bartch that court wan in session His honor was accordinglynoh r fied but the clerk returned with the information in-formation that the judge was engaged but suggested thathe presumed the board was willing to wait for him After a delay of a few minutes the judge not having materialized the selectmen thought it best to proceed without him and Mr Cahoon was elected chairman I The minutes of the previous meeting were read and approved and business was proceeded I pro-ceeded with I withTHE THE PROCEEDINGS Ed Nancarrow 56 years of age who was discharged from the county infirmary a short time ago sa able to work appeared ap-peared in person and asked that he be returned re-turned to that institution Superintendent Superinten-dent Hinman was present and stated with reference to the matter that the county physician had examined Nan carrow and thought that he sfionld be discharged The superintendent also stated that Nancurrow was too high toned for such an institution anyway When he was first taken there objected to bathing where the other inmates bathed and he also objected to having his clothes washed with those of the other paupers Nancarrow denied this and stated that he would rather be shot than to suffer as he had since he was discharged His petition however was denied and he was told to call on the county physician again and if the latter recommended his retu rn to the infirmary it would then be so ordered orderedFUNDS FUNDS < TDENED OVER C E Allen requested that an order be made authorizing him to pay over to his successor 44960 being the amount held by him to pay D P Benson for certain cer-tain contract work So ordered John Woodburn natural gas inspect tor reported that he had visited the fields several times but that his services were not required further than to make a cursory cur-sory examination The report was filed Justice B B Quinn of Bingham petitioned peti-tioned for leave to obtain a docket to use in his official capacity The petition was granted The county physician reported the following fol-lowing patients in the city hospitals St Marks 8 Deseret 13 total 13 Received and filed J Hanson petitioned for relict on account ac-count of an alleged wrongful assessment on certain property which said property was advertised for sale on January 12 The matter was referred to the county attorney at-torney and the collector notified not to make the sale until the attorney had made his report COUNTY TREASURERS REPORT ExConnty Treasurer Toronto sent in the following report Funds on band not subject to meeting POOR HOUSE REPORT Superintendent Hinman of the county infirmary submitted the following To the Honorable County Court GENTLEMEN With the close of this day 1 have acted In the capacity of your superintendent superintend-ent of the county Innrmary iltieen months and I herewith offer you the following short report covering that time to wit When I took charge of the place there were 33 inmates 21 of whom are still here 7 have died and 3 hare been sent to the insane asylum There has been 95 admitted during the fifteen monthsrmaking total number of 133 that have been under my chartre of that number 13 have died 5 have been sent to the insane asylum and 8 have been ticketed friends in the states 01 the total number 7 were born in Utah 36 In tho states and 89 or 67 per cent were j foreign born Two wore 2 months old 1 was 93 years old 1 was 89 7 others above 80 15 between 70 and W 22 between CO and 70 27 between 50 and 60 and the balance between the ages of 19 and 50 At present there are 45 Inmates which is all the house can accommodate 2 of those we have are totally blind Us a helpless cripple and 1 an imbecile During the fifteen months there have been numerous improvements made in and about the place among which is the replumbing of the entire house on a modern plan putting new and larger drain pipes from same putting In new bath tubs and adaing basins and traps repairing the building throughout putting in a new double Steele range laying linolium on the floors of the entire house putting in tire extinguishers ex-tinguishers etc etc while outside additional i shade trees have been planted the yard and lawn beautified by the planting of shrubs and flowering plantsthe walks and drives graveled a barn and shed built and many other needed Improvements Received and
