Show IS HE IN CONTEMPT 1 T H Mackintosh Ignores Com Greenmans Order Thomas Larsen Has a Previous Judgment and a First Eight to tho Money Another kink was put In the tangled affairs af-fairs of the Utah Central railroad yesterday yester-day It will be remembered that on Thursday Thurs-day Commissioner Greenman ordered T J Mackintosh of the Utah Central to pay into court 1600 which was in his possession posses-sion to be applied on the judgment ab tained by J C Jones and eight other employees em-ployees of the road Mr Mackintosh failed to comply with the order on Friday as directed di-rected and yesterday morning he was served with a written notice to pay in the money lortnwitn and it was understood that if he failed to do this he would be imprisoned im-prisoned for contempt The gods who always had a liking for Tom intervened however and the result is that the tank line magnate has not gone to jail neither has he paid the money over to Commissioner Commis-sioner Greenman It seems that Thomas Larsen had obtained ob-tained a judgment against the Utah Central Cen-tral for 1600 in the Third district court and about the time Commissioner Green mans second notice was served on Mackintosh Mack-intosh that gentleman was notified to appear ap-pear before Judge Zane on an application made by Mr Rawlins Larsens attorney to have the 1600 in controversy paid on Larsens judgment On the hearing it wa shown that the money was received by Mr Mackintosh after the judgments had been rendered in the commissioners court and it was therefore not subject to the order of the court on these judgments Judge Zane therefore ordered that after some six small judgments which had acquired priority were satisfied the balance be applied on the Larsen judgment The defendant was allowed a stay of ten days and the money was paid over to the clerk of the court and Mackintosh was afterwards allowed to go by Commissioner Greenman until Monday when the whole case will probably be brought before Judge Zane for roview |
