| Show SIIlRF rltACrICE ALLEGED A Itcal Estate Deal Ventilated in the District Court The case of B B Bitner vs Albert J r White in which the plaintiff substantially substan-tially charged the defendant with a little sharp practice in his mode of making a certain real estate deal was taken up before be-fore Judge Zane yesterday The complaint com-plaint was rather lengthy but it alleged the following in substance On April 5 1890 White represented to Bitner that a certain piece of land could be purchased for 7000 in this city and asked him to join in the purchase Bit ner assented to the proposition and put up 3500 for his share of the purchase price and later the property was transferred trans-ferred to plaintiff and defendant by W S McCornick Later however the plaintiff ascertained ascer-tained or thought he did that shortly prior to the purchase by Himself and defendant de-fendant from McCornick White had purchased the property from one William UDfleld for f4800 and had caused it to be conveyed to McCornick for the purpose of concealing from plaintiff the true consideration con-sideration involved Hence the plaintiff demanded judgment against the defendant for 1100 with interest in-terest that amount representine the differenco between what he should have paid and what Le did pay The defendant denies any lack of good faIth on his part and alleges that he purchased pur-chased the property from Upfield for JMcCornicfc andat the time was not interested in-terested in the deal himself At a later date he concluded to purchase the property prop-erty from McCornick and plaintiff joined with him in the same Defendant also it alleges that he paid 53500 forhia interest Jr A jury was waned and trial had before the court Judge Howat and George L Nyc appeared ap-peared for the plaintiff and Judge Loof bourow for the defendant The case was hotly contested on both sides and was one of more than ordinary interest Afc the adjournment hour the opening argument had been made by Judge Howat and Judge Loof bourow will close this morning |
