Show CHARGED WITH HERESY Two Celebrated Cases Sow on Trial In ROlf f York and Cincinnati NEW YOKE Nov 23 Members of the Kow York Presbytery assembled this afternoon af-ternoon for the purpose of trying the charges of heresy against Professor Charles A Briggs Tho charges are eight in number and touch mostly on denial of the verbal inspiration of scrinturo and the possibility of salvation aside from the saying say-ing grace of scripture This afternoon Dr Briggs read his answer and charges as amended The response was a most exhaustive summing up of his defense and took two hours for delivery Among other things Dr Bnggs lays objection to tho order non regularity of every proceeding in the Prosbytery in any action taken against him since the dismissal of the orig inal charges in li > 9L He said if the Presbytery Pres-bytery decide against iiim he will proceed under protest nnd with oreservation of all legal rights of securing such redress in a higher court as may seem necessarv Dr Briggs dealt at great length with the Irregularity of the amendments to the original charge objecting that the nature of the original charges bed been changed When Dr Briggs bad concluded Mr I amper of the prosecuting committee submitted sub-mitted an answer in which he attempted p lo show the falsity of tho defendants statement that the general nature of the charges was changed in tue amended report re-port He also claimed that the changes jnade effected In tho were interest of conciseness con-ciseness and with the purpose of meeting the objections raised by Briggs at a provi ious trial Rev Georce Alexander moved in consequence conse-quence of Briggs objections that the fourth and seventh charges be stricken out Dr Sutton immediately offered as an amendment that Briggs objections were not well taken He made argument on this i I 1 SJ C point but was interrupted by Dr John R Paxton who shouted Give us a decision t nnd stop his talking Lawyer McCook of the prosecuting committee 1 com-mittee restored quiet by proposing that consideration of the motion be postponed I until tomorrow the committee in the meantime mean-time to consider the objection A recess until tomorrow was then taken The smIth Trial CixcxNNTI Nov 2STho heresy case of Professor Henry Preserved Smith was resumed this morning A protest against the action of the presbytery at the last I session in voting to sustain the first charge ns proper in form and legal in effect was I filed end arguments proceeded as to the legality of form and effect of the second charge which is that Professor Smith taught that the holy spirit did not control inspired writers in the composition of holy scriptures so as to make their utterances j I absolulely free from error A number of members spoke in favor of sustaining the J I chires i At tao afiernoon session a vote was I tan upon the sufficiency of the second jcaarje I in form and legal effect resulting I yeas 44 nays 17 The third and last j I charge is likely to be approved without debate I de-bate and then the trial proper begins i |
