Show DEFECTIVE LAM TITLES I TrouliIcK CaiiNctl Iiy n Suicide and the Ulrth of u ChilI New York Sept 12It is learned that during the past seven years many people bought real estate in Evans vine Ind of William Windsor who committed suicide at the Astor house I last Saturday Windsor gave warranty I deeds for real estate valued at over 50000 which he sold in parcels as he needed the money He owned i is said only a third Interest in the lots and as soon as a guardian or adminis trator is appointed to take care of the Interests of Windsors child Constance the purchasers of the Evansville property pro-perty will either have to pay two thirds of the purchase price over to Constance or surrender possession of the property Herbert F Andrews the lawyer who drew Windsors first wifes will said The first Mrs Windsor owned a large amount of property at Evansville Evans-ville She made a will in favor of her husband on September 18 liSt a few days before her first child Constance was born Under the law in this state and Indiana the birth of the only child after the execution of a will absolutely revokes the will and the person dies intestate Mrs Windsor died in 1SS3 without having made a new will She w1 willed everything to her husband and fully intended he should have every thing I told them when I drew the will just how the birth of a child would affect it but they never consul ted me about the matter afterwards The will was admitted to probate shortly after Mrs Windsor died In 1888 in this city and I obtained for Mr Windsor a proper copy for record In Indiana Under the law of Indiana In such cases the husband receives one third the children twothirds In the many different sales of property Windsor Wind-sor made to Evansville people i Is strange that the titles were not in a few Instances thoroughly searched It was not until within the last two weeks that anyone in Evansville knew of the defective titles The child Constance owns twothirds of all the property left to her mother in TCvnnavUta hl lef fathers deeds are good for only c one third The lawyers In Indiana who made the conveyances for Windsor are liable for the losses which will ensue to the purchasers wi |
