Show PULLING FOIl KANE The Washington correspondent of the Chicago Time wires his paper as follow the dispatch appearing under the head Pleading for Tudge Z vxi in last Saturdays Satur-days issue Judge Bcccncn of the Ohio t Mississippi railroad an old friend of President HAUUI OX and AttorneyGeneral MILIDU is here with F W TRACY president presi-dent of the First National bank of Springfield Spring-field Ill urging the appointment of Judge CntmEi S XISE as chief justice of Utah ibe position he held under AUTHUU They called on the President today and presented a petition signed hy over 4000 Gentile residents resi-dents of the territory Tudge ZXK was I Senator CCMOMS law partner at the time the latter was elected governor of Illinois The Mormons will probably make a strong tight against Judge HASHS reappointment for during the time he presided over Utah he sent scores of polygamists to the penitentiary peni-tentiary I is presumed that the handful of admirers ad-mirers of Judge ZAXK there being about a handful of men not yet disgusted by him will find encouragement if not comfort in the above But we suggest to them the wisdom of not permitting their spirits to become too jubilant over this dispatch I they will read the words carefully and in i calmness they will find in the lines nothing upon which they can base a reasonable hope They will not discover tierein ally thing suggestive of a vacancy in the of flee of chief justice and they must all know that there cannot be two chief Justices for one territory at the same time Judge SAXDFOunstill occupies the position and so far as wo have been able to learn he is content to continue for a season at least he has not proposed to please his enemies and disappoint his friends by making a vacancy for XAXE or anybody else to fill In tiis connection it may not be out of place t mention certain things that have a bearing on the chief justice ship It has boos published at regular intervals in-tervals and on reliable authority from trustworthy sources and so on tha t Chief Justice SsxlronD hat resigned Now Tnn HUIHII is i not in Judge SAXD rouns confidence but we havo the same opportunities which others enjoy of ascer taming when resignations of federal officers ers ara sent to the President and thus el are enabled to say with positivencss that if i lodge SANDFORD has resigned he has done so within a very few hours We can further say that wa dont believe he contemplates con-templates or that ha has contemplated resigning re-signing Another thing may be mentioned herewith here-with propriety Wo have heard a good deal about charges against Judge SAM roitn men and newspapers both declarim that the gentleaian could hot stand up Ul der the presentation filed against him Just what the charges were could not be ascertained but thorough search developed the fact that no accusation against the judge has been loJgel with the President with the attorneygeneral or in any of the departments of government The newspapers news-papers and the individuals that have been saying so much about him and tolling about the charges and accusations which he would have ta faze have never had the courage to allege anything against the gentleman gen-tleman where they might be called upon to prove it Judge SAXDKOKO record is ah solutely clean with fie administration as it has been on the bench and no man has had the hardihood or impudence to say a word against him to the powers that heAl he-Al this talk ab out charges therefore maybe may-be set down as so much ignorant or mali cious lying There cannot b3 much comfort for the friends of ZVXE 01 the enemies of SAXD rnnn in these revelations nor in the words tlt of President HAKUI OX to a gentleman who was asking for a judgeship for a friend The President said he would remove re-move no territorial judge whose record was clean and against whom there were no charges of wrongdoing that he did not regard re-gard the judges as political officers and that the law intended that the judges should serve at least one full term of four years HAIUSI OX further said that it would be insufficient in-sufficient to cause a removal to present general accusations against a judge alleging al-leging incompetency disqualification ands and-s on that specific charges must be presented by responsible parties and not only this but the charges must be proven to the complete satisfaction of the President Those who are opposed to SAXDFOKD and in favor of XAXE may get all the consolation there is in this statement state-ment of the Presidents position But leaving Judge SAXDFOIID out of the case entirely what hope is there for Judge ZAXEJ The least possible His record rec-ord on the bench is anything but creditable and President HAKRIOX knows all aboil that record The President is acquainted recorl quainted with ZAXES outrageous outrage-ous admistraiion of the law knows of his infamous rulings on the bench is familiar with his ebullitions of hate and manifestations of prejudice and is aware of the terrorizing practiced by him which paralyzed the industries of Utah and kept the entire community on tho verge of distract dis-tract on Knowing all this can cue conceive con-ceive it possible that the President will restore re-store Judge ZANE t power and place him in a position restore the awful state of affairs fairs which il inaugurated and maintained To suggest this is t reflect on General IlAUitiioxa intelligence and to charge him with narrowniiiidness with mean and unworthy un-worthy prejudices and with deepseated enmity toward the Utah community in short to make him as mean and hateful as short Z ct B has shown himself be Nothing President HAHIUSOSS career justifies any such vicious imputation Nothing that he has said or done warrants one in saying that he is disposed to do otherwise than light or that he hates Utah so much as t desire the persecution of her people and the destruction of her material prosperity THE HEIIALD has too much confidence in the fairness the sense of justice ali the desire t do the best of President HAKIII sox to think it possible that he will inflict fair Utah with a man who has for years confessed manifested if he has not openly venomous hate for the territory and its people Our belief in Hmm ox is such that we have no apprehcnsic us that Judge ZANE will be returned t the place which he left to the great relief of all who were interested in the peace and welfare o f the I oppressed dependency |
